چکیده
یکی از مباحث جدید که ظرفیت شایانی برای کاربست در حیطه علوم گوناگون و از جمله دانش فقه دارد پدیده هوش مصنوعی است. چه اینکه هوش مصنوعی به دلیل ظرفیت های جدیدی که در تحلیل و کنترل رفتار انسان ایجاد کرده و تأثیر شگرفی که بر زیست فردی و اجتماعی آدمیان دارد سبب شده پرسش های جدیدی درباره ارتباط این پدیده با اهداف شارع مقدس ایجاد شود. بنابراین، با وجود جدید بودن موضوع از حیث نظری، لزوم شناخت پدیده هوش مصنوعی و نیز تشریح نحوه ارتباط آن با علوم انسانی و اسلامی از اهمیت شایانی برخوردار است. جستار حاضر، با عنایت به اهمیت بحث، در پژوهشی مسئله محور و با اتخاذ شیوه توصیفی تحلیلی، گونه های تعامل پدیده یادشده را با یکی از زیرشاخه های مهم علوم دینی (دانش فقه یا حقوق اسلامی) مورد مطالعه قرار داده و با ارائه شواهد گوناگون چنین نتیجه گرفته است که فقه می تواند دست کم در سه حوزه از داده های هوش مصنوعی بهره گیرد: 1. در باب موضوع شناسی مسائل فقهی؛ 2. در باب تطبیق احکام فقهی با آموزه های اخلاقی؛ 3. در باب شناخت لوازم و اقتضائات مسائل نوین و مستحدثه.A Reflection on the Feasibility and Methods of Using Artificial Intelligence in Jurisprudence or Islamic Law
One of the new topics having great potential for application in various sciences, including jurisprudence, is the phenomenon of artificial intelligence. As artificial intelligence has created new capabilities in the analysis and control of human behavior and has had a tremendous impact on the individual and social life of human beings, new questions have been raised about the relationship of this phenomenon to the objectives of holy law. Therefore, despite the theoretical novelty of the subject, the need to understand the phenomenon of artificial intelligence and also to explain how it relates to the humanities and Islamic sciences is of great importance. Considering the importance of the discussion, the present research, utilizing a problem-oriented framework and using a descriptive-analytical method, has studied the types of interaction of the aforementioned phenomenon with one of the most important branches of theological sciences (jurisprudence or Islamic law). It concludes, by providing various evidence, that jurisprudence can use artificial intelligence data in at least three areas: 1 - The thematic study of jurisprudential issues. 2 - The context of the consistency of jurisprudence with moral teachings. 3 - The field of understanding the needs and requirements of new and emerging issues.
