چکیده
امروزه چالش حفاظت از محیط زیست در شمار جدی ترین مسائل جامعه بین المللی قرار گرفته است. تغییرات اقلیمی، از دست دادن تنوع زیستی و کاهش منابع آب شیرین مسائل جدی محیط زیستی اند که خصوصیات خاص آنها، این مسائل را به موضوع فرامرزی تبدیل کرده است؛ وضعیتی که در نتیجه ضرورت نقش آفرینی حقوق بین الملل و به طور مشخص نظام حل و فصل اختلافات بین المللی را ایجاب می کند. این مقاله به روش توصیفی-تحلیلی و با هدف تبیین نقش آفرینی محاکم داوری بین المللی در توسعه حقوق بین الملل محیط زیست، به بررسی آراء محاکم داوری بین المللی می پردازد. یافته های این نوشتار نشان می دهد که چگونه علی رغم نارسایی هنجاری و خلأهای حقوقی موجود، محاکم داوری بین المللی توانسته اند ضمن توجه به اجرای معاهدات منعقده فی مابین کشورها، ملاحظات محیط زیستی را به رسمیت شناخته و مورد توجه قرار دهند. چنین ایفای نقشی باعث شده است که نهاد داوری بین المللی در کاربرد، اعمال و نهایتاً توسعه حقوق بین الملل محیط زیست نقش قابل توجهی را ایفا کنند.The Role of International Arbitral Tribunals in the Development of International Environmental Law
Today the preservation of the environment has become one of the most pressing concerns among the global community. Climate change, biodiversity loss, and freshwater depletion pose significant environmental threats, and their distinctive attributes have transformed them into transnational issues. As a result, the situation in question necessitates the need for involvement of international law, particularly the system for the settlement of international disputes. This paper uses a descriptive-analytical method to explain the role of international arbitral tribunals in the development of international environmental law. The findings of this study show how international arbitral tribunals, despite normative insufficiency and existing legal gaps, have been able to recognize and address environmental considerations while complying with treaties concluded between states. Such effective function of arbitration courts has led the awards of international arbitral tribunals to play a significant role in the application, enforcement, and as a result, development of international environmental law.
