بررسی فقهی شبهاتی درباره مسئولیت حاکمیت اسلامی نسبت به اقامه حجاب (مقاله علمی وزارت علوم)

چکیده
اقامه حجاب یکی از مصادیق اقامه دین و از اهم وظایف حکومت اسلامی است که اتخاذ هر رویکردی درباره آن با تأثیرات متفاوتی در اجتماع و حکمرانی همراه خواهد بود. پژوهش حاضر به روش تحلیلی- اسنادی و با هدف بررسی فقهی مسئولیت حاکمیت اسلامی در مسئله اقامه حجاب با وجود مفاهیمی همچون عدم تنجز، عدم پذیرش، ترتب مفسده، عدم تأثیر و عدم رضایت اجتماعی درباره این موضوع انجام شد. نتایج بررسی ها نشان داد که هیچ یک از این موارد، رافع مسئولیت حکومت اسلامی نسبت به اقامه حجاب نیست. حکومت اسلامی باید با تحقق شرایط امربه معروف و نهی ازمنکر نسبت به تنجز تکلیف با ارشاد جاهل، و زمینه سازی تأثیر آن در جامعه از باب مقدمه واجب در محدوده ای که جامعه به معروف بودن آن اذعان دارد، با بی حجابی و آن نوع از بدحجابی که برای جامعه مفسده آور است، مقابله نماید. بهره گیری از ابزارها، شیوه های اجرایی و مجازا ت های متناسب با تفاوت های فرهنگی، برای جلوگیری از بروز تزاحم بین مصلحت الزام به حجاب و مصالح دیگر، ضرورت دارد.A Jurisprudential Investigation into the Doubts about the Responsibility of the Islamic Government to Wearing Hijab
Wearing Hijab is one of the examples of religion and it is one of the most important duties of the Islamic government that taking any approach about it has different effects on the society and government. This analytical-documentary research was conducted with the purpose of investigating jurisprudentially the responsibility of the Islamic government to the issue of Hijab regarding some concepts such as the lack of Tanajjoz, lack of acceptance, order of corruptions, lack of influence, and lack of social satisfaction. The results showed that none of them relieves the responsibility of the Islamic government to Hijab. The Islamic government must stand against not wearing Hijab and that kind of Hijab that has corruptions for the society by both providing the conditions of enjoining good and forbidding evil, concerning with the Tanajjoz of duty by guiding the ignorant people, and preparing the influence of Hijab in the society, as an obligatory introduction, in a region whose people acknowledge that as a good issue. It is necessary to take advantage of tools, implementation methods, and punishments that are appropriate to cultural differences in order to prevent conflict between the expediency of the obligation to wear Hijab and other expediencies.
