چکیده
موضوع اصلی پژوهش حاضر تبیین مفهوم حق اخلاقی و بررسی نسبت میان حق قانونی و اخلاقی با تاکید بر منظومه حقوق شهروندی است. ضمن بررسی مبانی حق اخلاقی از منظر دو ایده اخلاق کانتی و حقوق طبیعی به این پرسش خواهیم پرداخت که چگونه می توان بر مبنای تبیین فلسفه حق به سمت تحقق نوعی اخلاق گرایی در حوزه امورات شهروندی حرکت نمود تا از دل تحقق همین منظومه اخلاق گرایی، امکان اجرای بهینه و موثر رویکردهای قانونی و حقوقی بیشتر فراهم گردد و شهروندان به جای احساس اجبار در اطاعت از قانون، اخلاقاً خود را مکلف به تبعیت از قانون بپندارند؟ یافته های این پژوهش که به شیوه توصیفی و تحلیلی جمع آوری شده است، قائل بوجود حق اخلاقی و بر این باور است که اشخاص زمانی رفتار خویش را با قاعده هم سو می کنند که الگوی اخلاقی را بمثابه یک استاندارد رفتاری ببیند، بنابراین فرضیه نوشتار حاضر آن است که با تلقی حقوق شهروندی بمثابه حقوقی اخلاقی و با توجه به ارزش های درونی شکل گرفته و تایید شده در قالب حقوق شهروندی، می توان مشروعیت هنجارهای قانونی را بدلیل برخورداری از این خصیصه یعنی همسو بودن با اخلاق پذیرفت و در اطاعت و وفاداری به قانون عنصر تکلیف را با اجبار و کاربست ضمانت اجراهای خرد و کلان جایگزین کرد که در عمل به ارتباطی دوسویه میان دولت و شهروند می-انجامد. .explanation of the position of moral right in the realization of citizens' legal rights in society
The main issue of this research is to explain the moral right and examine the ratio of legal right and moral right with emphasis on the citizenship rights system. While examining the moral foundation of rights from the perspective of Kant and natural right, we take this question into account that How can we move towards the realization of a kind of ethicism in the field of citizenship based on the explanation of jurisprudence and provide more effective implementation of legal approaches so that citizens feel obligated to obey the law not obliged to obey the law. findings of this study, which have been collected in a descriptive and analytical manner, despite emphasizing the existence of a moral right, believes that people align their behavior with the rule only when they consider the moral model as a behavioral standard. Therefor the hypothesis of this research indicates that with considering the citizenship rights as moral rights, according to approved internal values, legal norms will be accepted cause its consistency with ethics which leads to the replacement of obligation concept with compulsion to obey the law and improves the relationship between citizen and government.
