چکیده
اتخاذ مجموعه راه کارهایی در قالب مجازات هنجارشکنان، اقدامی است که پس از کاربست راه کارهای پیشگیرانه و اصلاحی، با هدف حفظ انتظام و همبستگی اجتماعی، گریزناپذیر است. بررسی دیدگاه امام علی علیه السلام برای شناسایی مجموعه اقدامات مؤثر برای تحقق هدف مذکور و الگوگیری از آن در جامعه دینی، یکی از ضرورت های پژوهشی است که در این مقاله گزاره های مرتبط با مقوله مجازات از کتاب نهج البلاغه استخراج و با استفاده از روش کیفی و بهره گیری از تکنیک نظریه مبنایی، داده ها کدگذاری شده و سپس در قالب مقوله های محوری دسته بندی و در نهایت، مقوله گزینشی با عنوان «مجازات متنوع و متناسب با نوع کجروی» انتخاب و مورد تحلیل قرار گرفته شد. از آنجا که داده ها نظری و متن محور بوده، از روش تحلیل محتوا نیز برای توصیف آنها استفاده شد. در این راستا راه کارهایی از قبیل مجازات بدنی، مجازات روحی و روانی، مجازات سلب صلاحیت، مجازات اقتصادی و حتی با مجازات سلب حیات از افراد هنجارشکن مطابق با برخی جرم ها و با در نظر گرفتن شرایط به کارگیری هریک از مجازات ها، از کلام حضرت به دست آمد.Punishment as the last resort in controlling social deviance the case of sayings of Imam Ali (pbuh) in Nahjul Balagha
To maintain social solidarity and order, taking measures for the punishment of norm violators، subsequent to the employment of preventative and corrective measures, is inescapable. Reviewing the sayings and preaches of Imam Ali (pbuh) for eliciting the useful strategies in this regard and modeling it in a religious society seems to be a research imperative. In the present article, those statements in Nahjul Balagha that concern the issue of punishment have been extracted and codified by qualitative method, using grounded theory technique. Then the data have been categorized under certain main themes, and ultimately, the category of “punishment of criminals” has been selected and analyzed. In this line, solutions like bodily punishment, mental and psychological punishment, economic punishment, punishment in form of disqualification from one’s position, and even deprivation of life regarding some crimes, have been elicited considering the circumstances and the conditions in applying each punishment.
