بررسی تأثیر قانون گرایی بر میزان پیشگیری و کاهش جرائم و تثبیت نظم و امنیت در جامعه

چکیده
قانون گرایی در مجامع و نوشته های علمی به عنوان مفهومی بکار می رود که به اصالت قانون و اصول قضایی و حقوقی در روابط بین مردم و و دولت و همچنین روابط مابین خود مردم معتقد می باشد. بر طبق این عقیده در عرصه سیاست جهانی رفتار بین المللی ملاک عملکرد دول ،شرایط اخلاقی و اجتماعی نیست بلکه روابط حقوقی و شرایط تابعه آن معیار است. اکثر قانونگرایان بر این عقیده اند که دولت محصول قانون است و در مورد دولت ،جامعه و کشور باید تنها صلاحیت حقوقی ، قانونی و قضایی را در نظر بیاورد ، هرچند با اخلاق و مذهب متغایر و متضاد باشد. از سوی دیگر یکی از معضلات مهم جامعه ی امروز ، فرار از قانون در هر زمینه ای مشکلات زیادی را برای جامعه ایجاد کرده است. همزمان با گسترش انقلاب صنعتی و وسعت دامنه نیازمندی ها ، محرومیت های حاصل از عدم امکان تامین خواست ها و احتیاجات زندگی موجب توسعه شدید و دامنه دار فساد ، عصیان ، تبهکاری ، دزدی و بعنوان کلی جرم و جنایت شده است.به لحاظ حقوقی و قانونی جرم به هر فعل و یا ترک فعلی که در قانون برای آن مجازاتی تعیین کرده باشد تلقی می گردد. وجود رابطه معنا دار بین التزام به قانون و پیشگیری از جرم و کاهش جرائم و به تبع آن بالا رفتن میزان نظم و امنیت یک جامعه موضوعی است که در پژوهش حاضر مورد توجه قرار گرفته است.Investigating the Effect of Legislation on the Prevention and Reduction of Crimes and the Strengthening of Order and Security in the Community
