چکیده
توسعه و شکوفایی کشور در پرتو امنیت و ثبات اقتصادی رقم می خورد. ازاین رو مسئولین و نهادهای ذی ربط، قوانین و هنجارهای مختلفی را برای نیل بدین مقصود وضع نموده اند. در این میان پدیده قاچاق و به ویژه قاچاق کالا، آثار و پیامدهای مخرب و زیان باری به خصوص در رابطه با امنیت اقتصادی به همراه خواهد داشت. قاچاق کالا ضمن برهم زدن امنیت اجتماعی، اقتصاد جامعه را نیز با اختلال مواجه نموده و مسیر هموار رشد و پویایی کشور را با مانع روبه رو می سازد. ازاین رو نظام عدالت کیفری به عنوان حافظ و نگهبان منافع جامعه به مبارزه با این پدیده شوم برخاسته است؛ اما تدوین نظام کیفری عدالت محور و مبارزه همه جانبه با این پدیده، نیازمند شناخت علل، آثار و پیامدهای آن به ویژه در رابطه با امنیت اقتصادی جامعه می باشد. قاچاق کالا تأثیرات عمده ای بر امنیت اقتصادی، اجتماعی و فرهنگی کشور دارد که آثار و پیامدهای ناشی از این امر، ضرورت اتخاذ تمهیدات مناسب و کارآمد برای مقابله با این ناهنجاری را بیش ازپیش گوشزد می نماید. در این نوشتار کوشش شده تا ضمن بررسی نظام عدالت کیفری کشورمان پیرامون مبارزه با قاچاق کالا، علل این پدیده و تأثیرات آن را بر جامعه و امنیت اقتصادی موردبررسی، تجزیه وتحلیل قرار دهیم.Criminal Policy of the Islamic Republic of Iran on the smuggling of goods and the causes and effects of this crime in terms of economic, social and cultural security
Development and prosperity of the country is determined in light of security and economic stability. Therefore, authorities and relevant institutions have imposed different laws and norms to achieve this purpose. Meanwhile, trafficking and especially goods trafficking has destructive effects and consequences, especially in relation to economic security. Goods trafficking not only disturbs public security, but also it disturbs the economy of the society and blocks the well-worn path of growth and dynamism of the country. Therefore, the criminal justice system as a safeguard for the interests of society has started fighting against this ominous phenomenon; but developing a justice-based system of criminal justice and comprehensive fight against this phenomenon requires an understanding of its causes, effects and consequences particularly in relation to the economic security of society.
Goods trafficking has significant effects on economic, social and cultural security of the country. Its effects and consequences address further the need to adopt appropriate and effective measures to fight against this abnormality. In this paper, it is attempted to investigate the criminal justice system in our country. Also, the causes of this phenomenon and its effects on society and economic security will be analyzed.
