چکیده
استنطاق یا بازجویی بی شک یکی از مهم ترین مراحل تحقیقات مقدماتی است و ضابطین دادگستری به ویژه مأمورین پلیس در بدایت تشکیل پرونده قضایی نخستین سنگ بنای دادرسی کیفری را بازجویی مستحکم می نمایند، تدوین و اجرای قوانین در این حوزه می تواند مصونیت افراد را از خود اتهامی و عدم تضییع حقوق آن ها در برهه ای که فشار روانی بالایی بر فرد تحمیل می گردد به همراه داشته باشد قانون گذار ایران در سال 92 با تغییراتی که در قوانین بازجویی قانون آیین دادرسی کیفری داشت، تلاش نمود تا از حقوق افراد نزد ضابطین دادگستری دفاع نماید، قیاس حقوق افراد در دوران بازجویی با دیگر کشورهای جهان به طور اخص با کشور ایالات متحده آمریکا که حقوق افراد در زمان بازجویی را در حدود نیم قرن پیش به رسمیت شناخته است، می تواند شناخت بیشتری را در ذهن نسبت به میزان توجه قانون گذار ایران فراهم نماید در این پژوهش سعی شده است مطالعه تطبیقی حقوق دوران بازجویی نزد پلیس در نظام کیفری ایران و آمریکا انجام و میزان تضمین حقوق افراد در فرآیند بازجویی در قانون ایران روشن تر گردد.The role of agents in the interrogation of persons in the penal system of Iran and America
