سیاست جنایی ایران در قبال قاچاق و تجارت مشروبات الکلی

چکیده
در این مقاله از میان مصادیق گوناگون قاچاق کالا، قاچاق مشروبات الکلی که یکی از مهمترین و خطرناک ترین کالاهای قاچاق ورودی به کشور بوده و از طرف دشمنان به عنوان حربه ای امنیتی و اجتماعی به کار می رود مورد بررسی قرار می گیرد. در بررسی پدیده قاچاق مشروبات الکلی عوامل و زمینه های متعددی دخالت دارند که در تبیین و بکارگیری یک سیاست جنایی موثر، مطالعه و شناسایی تمام این عوامل می تواند راهگشا باشد. در واقع نه تنها در مرحله سیاست گذاری نیاز به یک رویکرد چندوجهی با تمرکز بر تمام ابعاد موضوع وجود دارد بلکه در مرحله اجرایی نیز رویکرد چند نهادی به پیشگیری از جرم با بکارگیری تمام ابزارهای موجود راهکاری موثر قلمداد می گردد. در خصوص قاچاق کالا به مفهوم عام و قاچاق مشروبات الکلی در مفهوم خاص باید توجه داشت که اگر چه تصویب قوانین مشدد می تواند یکی از عوامل بازدارندگی در ارتکاب جرایم به شمار آید، ولی همچنان که امروزه در علم جرم شناسی به اثبات رسیده نادیده گرفتن عوامل بسترساز ارتکاب جرم و پررنگ نشان دادن افزایش هزینه های ریسک در قالب قوانین به تنهایی نمی تواند نقش خود را در بازدارندگی ایفا نماید.Iran's Criminal policy in exchange for trade and trafficking alcohol

The findings :
regarding smuggling into the concept of alcohol and drug trafficking in specific concept should be noted that although legislation could be one of the factors in the inhibition of crimes , but as in forensic science today proved to be ignoring elements of the crime and strong showing increasing risk costs in the form of rules alone cannot play their role in deterrence .
