چکیده
از جمله مباحثی که در روایات مهدوی به صورت گسترده مطرح شده است، قضاوت بدون بیّنه و براساس واقع است. از ظاهر روایات استفاده می شود که این نوع از قضاوت با علم خدادادی و به صورت خارق العاده می باشد. براساس این پژوهش امام زمان؟عج؟ حداقل در برهه ای از حکومت خود از قضاوت داوودی بهره می برد و چنین قضاوتی نقش به سزایی در گسترش عدالت در جامعه پس از ظهور و کاهش جرم دارد و امام زمان؟عج؟ به سبب آن، مجرمان خاص و حرفه ای را محاکمه و مجازات می نماید که برای سایرین نیز بازدارنده خواهد بود. چنین قضاوتی به اقتضای ضرورت است، هرچند رویه عمومی دستگاه قضایی در حکومت آن حضرت، قضاوت براساس ظواهر و شواهد است. این تحقیق با روش جمع آوری کتابخانه ای و تحلیل داده ها، ابتدا به گزارش روایی این مسئله و اثبات صحت و سقم روایات پرداخته و پس از تحلیل و بیان کارکردها، شبهات این مسئله را پاسخ خواهد داد.Proving the judgment of Imam Zaman, expressing the functions and answering the doubts
One of the issues that has been widely discussed in Mahdavi narrations is judgment without evidence and based on fact. The appearance of the narrations is used, which is a kind of judgment with God-given knowledge and in an extraordinary way. According to this study, Imam Zaman uses the judgment of Davoodi at least at some point in his rule, and such judgment plays an important role in promoting justice in a society after the emergence and reduction of crime. And because of that, Imam al-Zaman (as) will try and punish special and professional criminals, which will be a deterrent for others as well. Such a judgment is necessary, although the general practice of the judiciary in the rule of that Imam is to judge on the basis of appearances and evidence. This research, by the method of library collection and data analysis, first reports the validity of this issue and proves the accuracy of the narrations, and after analyzing and expressing the functions, will answer the doubts of this issue.
