بررسی حقوق اتباع برای مقابله با اخراج و تبعید در زمان جنگ در حقوق بین الملل

چکیده
گسترش روابط بین الملل و نیز گسترش مسائل سیاسی و اجتماعی مختلف در جهان، موجب شده تا روابط مردم دنیا افزایش بیابد و به دنبال آن ورود اتباع بیگانه به کشورهای مختلف گردد که می تواند در مواردی زمینه ساز تعارض با منافع کشور میزبان و به وجود آورنده مسائل مختلف حقوقی باشد. اما این ورود اتباع در زمان جنگ و شرایط خاص جنگی، ویژگی های و ابعاد حقوقی خاص خود را پیدا می کند. بر این اساس هدف این پژوهش بررسی حقوق اتباع برای مقابله با اخراج و تبعید در زمان جنگ در حقوق بین الملل و چالش های مهم و اساسی مربوط به آن است. در زمان جنگ شرایط و ضوابط اخراج اتباع با زمان صلح فرق دارد. حتی کشوری که قبل از جنگ همسایه و متحد کشوری بوده، با شروع شرایط جنگی روند ارتباطات خود را تغییر می دهد که اولین اثرات آن در اخراج و آزار و اذیت اتباع دیده می شود. این مقاله با روش توصیفی و تحلیلی به دنبال مطالعه حقوق اتباع برای مقابله با اخراج و تبعید در حقوق بین الملل است. نتایج بدست آمده نشان می دهد که اخراج بیگانگان حتی در زمان مخاصمات مسلحانه باید براساس محدودیتهای شکلی و ماهوی اخراج طبق حقوق بین الملل در زمان صلح، مثل محدودیت های حقوق بشری، صورت بگیرد.Examining the rights of citizens to combat deportation and deportation in time of war in international law

Accordingly, the purpose of this study is to examine the rights of citizens to deal with deportation and deportation during wartime in international law and its important and fundamental challenges. In time of war, the conditions and rules of deportation are different from in time of peace. Even a country that was a neighbor and ally before the war, changes the course of its relations with the onset of war, the first effects of which are seen in the expulsion and persecution of its citizens. This article seeks to study the rights of citizens to deal with deportation and deportation in international law through descriptive and analytical methods. The results show that the expulsion of aliens, even in times of armed conflict, must be based on formal and substantive deportations under peacetime international law, such as human rights restrictions.
