چکیده
اهمیت و توسعه روز افزون ورزش و مسائل مربوط به آن، انبوهی از مباحث و پرسش ها را پیش روی فقه ما قرارداده است، به گونه ای که صحبت از ایجاد گرایشی تخصصی به عنوان «فقه ورزش» مطرح است. باید اذعان نمود که پرداختن به فقه ورزش، باید با مطالعه و بررسی پرسش های زیر بنایی صورت گیرد؛ از جمله این که آیا می توان فقه ورزش را به مثابه یک گرایش فقهی تخصصی محسوب کرد و اساساً جایگاه آن در منظومه فقه چیست؟ وبرای تأسیس آن چه اقداماتی باید صورت پذیرد؟ نوشتار حاضر، با نگاهی به جایگاه ورزش و بیان ضرورت و معیارهای تخصصی کردن فقه، ثابت کرده که فقه ورزش، از معیارهای مزبور برخوردار است، از این رو باید به شایستگی مورد توجه قرار گیرد؛ ایجاد و توسعه مطلوب فقه تخصصی ورزش، باید گام به گام و با برنامه مناسب باشد، خاصه آن که در این مسیر، وجود یک برنامه آموزشی جامع نیاز است؛ به گونه ای که قابلیت ارائه آن در حوزه علمیه و مراکز فقهی فراهم شود. هم چنین وجود اساتید و متون آموزشی مناسب در زمره مهم ترین بایسته ها محسوب می گردد.Necessity and Requirements of Sports Jurisprudence
The increasing importance and development of sports and related issues has brought a lot of discussions and questions to our jurisprudence, so that there is a tendency for creating a specialized subject as "sports jurisprudence". It should be acknowledged that dealing with sports jurisprudence should be done by studying and examining the underlying questions; For example, can sports jurisprudence be considered as a specialized jurisprudential subject and, basically, where is its place in the jurisprudence system? And what steps should be taken to establish it? The present article, by looking at the status of sports and expressing the necessity and criteria for specialization of jurisprudence, has proved that sports jurisprudence includes these criteria; therefore it should be properly scrutinized. The creation and optimal development of specialized sports jurisprudence should be step by step and with an appropriate program, especially because in this course the existence of a comprehensive educational program is needed in such a way that it can be presented in seminaries and jurisprudential centers. Also, the presence of appropriate professors and educational texts is among the most important requirements.
