تأثیر اسناد بین المللی در رویکرد قانون گذاری ایران در زمینه سیاست جنایی تقنینی حاکم بر مواد مخدر (مقاله علمی وزارت علوم)

چکیده
این مقاله به بررسی تأثیر اسناد بین المللی در سیاست جنایی تقنینی مواد مخدر در ایران می پردازد. روش پژوهش در این مقاله به صورت تحلیلی توصیفی و روش گرد آوری داده ها بصورت کتابخانه است. در این مقاله تجزیه و تحلیل اثرگذاری کنوانسیون سازمان ملل متحد علیه مواد مخدر و سایر اسناد بین المللی در سیاست های مواد مخدر ایران بررسی شده است. معرفی و بررسی اهمیت اسناد بین المللی، نقش آن ها در قانون گذاری ایران و تأثیر آن ها در بهبود سیاست ها و برنامه های مواد مخدر در ایران مورد توجه قرار گرفته است. در ادامه، کنوانسیون سازمان ملل متحد علیه مواد مخدر و استانداردهای بین المللی مرتبط با مواد مخدر مورد بررسی قرارگرفته است. همچنین، قوانین و مقررات مواد مخدر در ایران و تحلیل تطابق آن ها با استانداردهای بین المللی تجزیه و تحلیل شده است. سپس، تأثیر مستقیم و غیرمستقیم اسناد بین المللی در سیاست جنایی تقنینی ایران در زمینه مواد مخدر و تغییرات و بهبودهای صورت گرفته در سیاست های مواد مخدر ایران به عنوان نتیجه تأثیر اسناد بین المللی بررسی گردیده است. در انتها، پیشنهادها و توصیه هایی برای بهبود سیاست های مواد مخدر در ایران ارائه شده است. همچنین، یافته های این مطالعه نشان می دهد که تقویت همکاری بین المللی، توسعه برنامه های پیشگیری و آموزش، تحسین نظارت و مبارزه با قاچاق و ترویج تحقیقات و آمارگیری دقیق، می توانند بهبود قابل توجهی در سیاست های مواد مخدر در ایران به همراه داشته باشندThe effect of international documents on Iran's legislative approach in the field of legal criminal policy governing narcotics
This article examines the impact of international documents on the legal criminal policy of narcotics in Iran. The analysis of the effectiveness of the United Nations Convention against Narcotic Drugs and other international documents in Iran's drug policies has been done comprehensively and accurately. Introduction and review of the importance of international documents, their role in Iran's legislation and their impact on improving drug policies and programs in Iran have been considered.In the following, the United Nations Convention against Narcotic Drugs and international standards related to narcotic drugs are examined. Also, the laws and regulations of narcotic drugs in Iran and the analysis of their compatibility with international standards have been examined.Then, the direct and indirect effect of international documents on Iran's legal criminal policy in the field of drugs and the changes and improvements made in Iran's drug policies have been investigated as a result of the impact of international documents.At the end, suggestions and recommendations for improving drug policies in Iran have been presented. Also, the conclusion of this study shows that strengthening international cooperation, developing prevention and training programs, strengthening monitoring and combating trafficking, and promoting research and accurate statistics can bring significant improvement in drug policies in Iran.
