بررسی مسائل و چالش های اجرایی قانون حمایت از خانواده و جوانی جمعیت در ایران (مطالعه موردی استان گیلان) (مقاله علمی وزارت علوم)

چکیده
با توجه به کاهش باروری و نرخ موالید در ایران ، نظام سیاستگذار در ایران اقدام به تغییر سیاستهای جمعیتی نموده تا از این طریق ضمن وضع قوانین خاصی در حوزه جمعیت و خانواده و تشویق جامعه به فرزندآوری، از کاهش فزاینده جمعیت جلوگیری نموده و زمینه افزایش نسبی آن را فراهم نماید. از آنجا که گیلان از جمله پیرترین استانهای کشور است و مسئله کاهش جمعیت و نرخ موالید یکی از مهمترین مسائل این استان به شمار می رود در این پژوهش کیفی تلاش شد تا با استفاده از مصاحبه عمیق با شماری از صاحبنظران و کارشناسان حوزه خانواده و جمعیت در گیلان، مهمترین مسائل و خلأهایی قانونی و چالش های سیاستی و اجرایی «قانون حمایت از خانواده و جوانی جمعیت» در گیلان احصاء و راهکارهای عملیاتی جهت تحقق اهداف سیاستهای جمعیتی متناسب با نیازها و نظام مسائل استان ارائه گردد. یافته های پژوهش نشان می دهد جهت حل مسئله جمعیت توجه به نقش مؤلفه های فرهنگی و ذهنی در مقایسه با مؤلفه های اقتصادی از اهمیت بیشتری برخوردارند. چالشها و موانع موجود بر سر راه تحقق اهداف قانون در چهار حوزه اجرایی و مدیریتی، حوزه فرهنگی و اجتماعی ، حوزه آموزشی و رسانه ای و حوزه بهداشت و درمان وجود دارد. در نهایت با توجه به مسائل و چالشهای موجود، راهکارهای عملیاتی متناسب با نظام مسائل حوزه جمعیتی در استان استخراج و در پنج حوزه آموزشی و تربیتی خانواده محور، رسانه ای و تبلیغی، بهداشتی و درمانی ، اجرایی و مدیریتی ، فرهنگی و اجتماعی پیشنهادهایی با اتکا بر نظر کارشناسان ارائه گردید.Examining the implementation issues and challenges of the Family and Youth Protection Law in Iran (case study of Gilan province)
Considering the decrease in fertility and the birth rate in Iran, the policy-making system in Iran has changed demographic policies in order to prevent the increasing decrease in the population and the relative increase of provide it. Gilan is one of the oldest provinces in the country, and the issue of population decline and birth rate is one of the most important issues of this province. In this qualitative research, an attempt was made to use in-depth interviews with a number of experts and experts in the field of family and population in Gilan. The most important legal issues and loopholes and political and executive challenges of the "Family and Youth Protection Law" in Gilan, statistics and operational solutions to achieve the goals of population policies in accordance with the needs and system of the province should be presented. The findings of the research show that in order to solve the population problem, attention to the role of cultural and mental components is more important compared to economic components.There are challenges and obstacles on the way to the realization of the goals of the law in four executive and management areas, cultural and social areas, educational and media areas, and health and treatment areas. Finally, according to the existing issues and challenges, operational solutions appropriate to the system of demographic issues in the province are extracted and suggestions are made in five areas of family-oriented education and training, media and propaganda, health and treatment, executive and managerial, cultural and social.
