چکیده
پناهندگی یکی از حقوق بنیادین بین الملل بشر است، دولتها موظفند برای برآورده شدن این حق، آنرا به رسمیت بشناسند و به آن احترام بگذارند؛ اما قبل از آنکه فردی به عنوان پناهنده در کشور پذیرنده شناخته شود، باید احراز شود که آیا ترس موجه از آزار و اذیت دولت متبوع خود، ناشی از علل مربوط به نژاد یا مذهب یا ملیت یا عضویت در گروه های اجتماعی و داشتن عقاید خاص سیاسی وجود دارد یا خیر. از آنجا که این فرد در دوران اثبات ادعای پناهندگی، محروم از حمایت دولت متبوع خود است به همین دلیل نمی توان وی را به عنوان شهروند کشور متبوع دانست. از طرفی، دولت پناه پذیر هنوز این شخص را به عنوان پناهنده نپذیرفته است که حمایتهای لازم را از وی به عمل آورد، بنابراین، این فرد واجد عنوان خاصی می شود. وضعیتی که فرد در آن قرار دارد ، وضعیتی است بین شرایط «شهروندی» و «پناهندگی» که به آن «پناهجویی» اطلاق می شود. در این مقاله سیر تحول تاریخی واژگان پناهجو و پناهنده مورد بررسی قرار می گیرد و واژه پناهنده طبق کنوانسیون مربوط به حقوق پناهندگان ارزیابی می گردد و تفاوت میان واژه پناهنده و واژه پناهجو آشکار می گردد.The Evolving process of Clarification of Refugee and Asylum Seeker’s Concepts
The right of seeking asylum is one of the fundamental international human rights law. To realize this right, governments are obliged to recognize and respect it. However, before being recognized as a refugee in the receiving country, a well-founded fear of being persecuted for reasons of race, religion, nationality or membership of a particular social group or holding of a special political opinion should be verified. Since, such a person is deprived of his respective governments’ support during the period of his eligibility proof , he may not be considered as the citizen of his country of origin. On the other hand, since he has not been recognized as a refugee by the receiving country, he would not be entitled to the support of the latter either. Therefore the said individual qualifies a special status which is known as “asylum seeker”; a situation between “citizenship” and “refugee” circumstances. This article, while reviewing the historical and evolving process of asylum seeker and refugee terminologies, and assessing the word “refugee” in accordance with the 1951 refugee convention , attempts to clarify the differences between the words “refugee” and “asylum seeker”.
