تأثیر نظام حقوق مالکیت فکری بر آلودگی کلان شهرها (مقاله علمی وزارت علوم)

چکیده
صنعتی شدن جوامع بشری در کنار مزایای فراوان خود، چالشها و معضلات بسیاری را به همراه داشته که آلودگی کلان شهرها نمونه بارز آن است. برای تقلیل این مشکل، سیاست گذاران کشورهای مختلف در سطح داخلی و بین المللی، مدتهاست به شناسایی عوامل مرتبط با این بحث و اتخاذ سیاستها و تصمیمات متعدد مبادرت ورزیده اند. در میان این عوامل، حقوق مالکیت فکری با توجه به نظام و آثار خاص خود، دارای اثری دوسویه بر آلودگی کلان شهرهاست یعنی از یکسو می تواند باعث کاهش و از سوی دیگر موجب افزایش آلودگی گردد. از این روست که دبیرکل جدید وایپو در سال 2009، پرداختن به این موضوع را مورد تأکید قرار داده است. به رغم این اهمیت، تاکنون در ادبیات حقوقی ما به این بحث پرداخته نشده است، لذا این مقاله برای رفع نسبی این خلأ تحقیقاتی و پاسخ به این پرسش که حقوق مالکیت فکری چگونه می تواند باعث کاهش یا افزایش آلودگی کلان شهرها شود، در دو بخش اصلی تقسیم ارائه می شود: در بخش نخست، دلایل پیوند مقوله مالکیت فکری با آلودگی کلان شهرها و در بخش دوم، مصادیق تأثیر مالکیت فکری بر آلودگی مزبور، مورد بررسی تحلیلی و تطبیقی قرار می گیرد. در پایان مقاله نیز توصیه های سیاستی کاربردی به قانونگذار، سیاست گذاران و دستگاهای اجرایی کشور در زمینه مالکیت فکری پیشنهاد می گردد.The Effect of Intellectual Property Rights System on Metropolis Pollution
Although industrialization of societies has have advantages, it has have many challenges such as pollution of metropolis. Policy-makers of different countries have been identifying the factors causing pollution in order to decrease it at national and international levels. Intellectual property rights (IPRs) have positive and negative effects on metropolis pollution because they cause reduction or aggregative of pollution; thus in 2009, WIPO new Secretary-General emphasized on challenges between IPRs and pollution. In spite of this importance, Iranian legal literature has not paid attention to this issue; therefore, this article tries to consider the mentioned challenge. It constitutes two main sections: the first section surveys connection between IPRs and metropolis pollution; and second section considers instances of effects of IPRs on pollution by analytical and comparative approach. Finally, it suggests practical remarks to Iranian legislator, policy-makers and executives in the field of IPRs.
