چکیده
اعتراضات در نقطه مقابل اطاعت و فرمانبری، به معنی سرپیچی از دستورات و اعتراض به قوانین است. این مفاهیم وجوه تشابه و تمایزی دارند و دارای احکام معینی هستند تا انسان به سوی مسیر کمالش حرکت کند که این جرائم مانع این حرکت می شوند. لذا این پژوهش به بررسی تمایز مفهومی و حکمی محاربه و اعتراضات مدنی با محوریت و تاکید در دیدگاه امام خمینی(ره) پرداخته است. نتایج این پژوهش نشان می دهد رابطه محاربه و اعراض مدنی، عموم و خصوص من وجه است؛ یعنی بعضاً در محاربه اعتراض مدنی هم صورت می گیرد و برخی از آنها توام با محاربه می باشند. اعتراض مدنی متضمن توسل به سلاح لزوماً نیست که ممکن است در راهها و شوارع و سالب امنیت عمومی نباشد هر چند در مصادیق جرم سالبه امنیت اعمال کیفر همراه با شدت عمل خواهد بود ولی خروج مصداقی با کیفر محارب دارد. جرم محاربه چنانچه در داخل شهرها نیز واقع شوند مشمول حکم شدید محاربه می شوند. رابطه محاربه و بغی که از وجوه اعتراضات مدنی می تواند باشد عموم و خصوص من وجه است زیرا دو مفهوم علاوه بر داشتن مصادیق مشترک، مصادیق مخصوص به خود را نیز دارند و ... شارع مقدس برای حفظ ارزشهای انسانی و اجتماعی در مرحله اول به نشر تعلیمات اخلاقی، در مرحله دوم امر به معروف و نهی از منکر و در مرحله بعد به اجرای حدود و تعزیرات اهتمام دارد. این پژوهش به روش توصیفی از نوع کتابخانه ای با هدف کاربردی، جهت پاسخگویی به نیازهای جامعه می باشد که می تواند در مراکز مختلف آموزشی و پژوهشی مورد استفاده قرار گیرد.Social tolerance to deal with civil insurgency

If the crime of moharebah occurs inside the cities, they will be subject to the severe sentence of moharebah. The relationship between muharibeh and baghi, which can be one of the aspects of civil protests, is public and private, because the two concepts, in addition to having common examples, also have their own examples and... the sacred law for preserving human and social values in the first stage He is interested in publishing moral teachings, enjoining good and forbidding evil in the second stage, and enforcing limits and punishments in the next stage. This research is a descriptive library-type research with an applied purpose, in order to respond to the needs of the society, which can be used in various educational and research centers.
