نقد و بررسی اصطلاح «افراد تحت تکفل» در مواردی از قانون مالیات ها و مقایسه آن با «اقارب واجب النفقه» (مقاله علمی وزارت علوم)

چکیده
عبارت «کفیل» و «کفالت» از جمله واژه هایی است، که در رشته های مختلف حقوق، کاربرد واحکام مختلفی دارد. در حقوق مدنی، کفیل، مکلف به احضار مکفول عنه است. در حقوق اداری؛ کفیل ، مدیریت وزارتخانه یا اداره و یا موسسه ای را در غیاب وزیر یا رئیس به عهده می گیرد.. در مقررات رفاهی؛ کفیل عهده دار نگهداری، سرپرستی و یا پرداخت هزینه زندگی دیگری است. در این پژوهش که به روش توصیفی- تحلیلی صورت پذیرفته؛ موادی از قانون مالیات های مستقیم که تعبیر«تحت تکفل» به کار رفته، مورد مطالعه قرار گرفته است. تعبیر مذکور ضمن اینکه مبهم بوده، از ابعاد دیگر نیز محل بررسی است. در تبصره (1) ماده (53)ق.م.م اینکه چه کسی می تواند «تحت تکفل» قرار گیرد، مشخص نیست. در ماده 137 نیز برای کفالت معیار و ضابطه مشخص نشده و معلوم نیست در چه صورتی یک شخص «تحت تکفل» دیگری قرار می گیرد. در این ماده اولویت انفاق بر اقارب عمودی نیز مورد توجه قرار نگرفته است.Cash on Articles (137) and (53) of the Tax Law and its equivalence with the obligation to pay alimony to relatives in Islamic law

In this research, which was carried out using a descriptive-analytical method; The articles of the direct taxes law where the term "under the responsibility" is used have been studied. While the mentioned interpretation is vague, it is also subject to investigation from other dimensions. In Note (1) of Article (53) of the Civil Code, it is not clear who can be "under takaful". Article 137 also does not specify the criteria and rules for suretyship, and it is not clear in what way a person is "under the responsibility" of another person. In this article, the priority of giving to vertical relatives has not been considered.
