چکیده
زمینه و هدف : قضازدایی در جرائم خرد از موضوعات مهم حقوق کیفری است که محل بحث و نظر است. هدف مقاله حاضر بررسی چالش ها و راهکارهای قضازدایی در جرائم خرد است. مواد و روش ها : مقاله حاضر توصیفی-تحلیلی است. مواد و داده ها نیز کیفی است و از فیش برداری در گردآوری مطالب و داده ها استفاده شده است. ملاحظات اخلاقی : در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها : یافته ها بر این امر دلالت دارد که در حقوق کیفری ایران، رویکرد ویژه و خاصی برای قضازدایی در جرائم خرد اتخاذ نشده است. تعارض در تقنین، تعدد و کثرت مراجع قانون گذاری، ضعف تخصص و تخصص گرایی، فردگرایی و اعمال سلایق شخصی و رویکرد سنتی در قانون گذاری کیفری جرم انگاری افراطی از چالش های مهم فراروی قضازدایی در جرائم خرد در ایران است. اصلاح ساختار نظام قضایی کشور، بازنگری اصلاح قوانین مقررات و اجرای قضازدایی به روش های مختلف از مهم ترین راهکارهای قضازدایی در جرائم خرد است. نتیجه : قضازدایی در جرائم خرد نقش مهمی در کاهش حجم ورودی پرونده ها به مراجع قضایی دارد. لازم است قانون گذار رویکرد مناسبی در این خصوص اتخاذ کند.Decriminalization of petty crimes: challenges and solutions
Background and Aim : Decriminalization in petty crimes is one of the important issues of criminal law that is a subject of debate and opinion. The purpose of this article is to examine the challenges and solutions of decriminalization in petty crimes.
Materials and Methods : This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.
Ethical Considerations : In this article, the originality of the texts, honesty and trustworthiness are observed.
Findings : The findings indicate that in Iran's criminal law, no special approach has been taken to decriminalize petty crimes. Conflict in legislation, multiplicity and plurality of legislative authorities, weakness of expertise and specialization, individualism and application of personal preferences and traditional approach in criminal legislation of extreme criminalization are among the important challenges to the decriminalization of petty crimes in Iran. Reforming the structure of the country's judicial system, revising the amendment of laws and regulations, and implementing decriminalization in different ways are among the most important methods of decriminalization in petty crimes
Conclusion : Decriminalization of petty crimes plays an important role in reducing the volume of incoming cases to judicial authorities. It is necessary for the legislator to adopt a suitable approach in this regard.
