تحلیل رابطه حقوقی و رفتار بازیگران سیستم حقوقی ثبت اولیه املاک بر مبنای نظریه بازی ها و معیار پازنر در کارآیی اقتصادی (مقاله علمی وزارت علوم)

چکیده
در سیستم حقوقی ثبت اولیه املاک که ملک نخستین بار ثبت میشود، زمینه اخذ تصمیمات استراتژیک در قرارداد اجتماعی میان «دولت یا کارگزار حقوقی» و «مالکین یا استفاده کننده» سیستم فوق در ورود به نظام ثبتی و انتخاب نوع و آثار حقوقی آن یعنی ثبت ثانویه املاک وجود دارد، لذا تحلیل روابط حقوقی آنها بدون توجه به نظریات اقتصادی بازیها و پازنر، کارآیی اقتصادی نظام ثبت را محقق نمیسازد. پیش بینی نتایج رفتار حقوقی بازیگران نظام ثبت و درک بهتر ساختار نظام مزبور، هدف تحلیل این نظام طبق نظریه بازی میباشد. سوال اینست که توجها به قانون ثبت،تئوری بازی با کدام راهبرد، ضرورت وجود و اثر ثبت اولیه املاک را توجیه میکند و توجها به مختصات سیستم ثبت اولیه در ایران، چه نوع سیستم ثبت اولیه و با چه اوصافی، کارآیی اقتصادی دارد. پژوهش حاضر با تحلیل میان رشته ای، به تبیین رفتار و روابط حقوقی بازیگران نظام ثبتی وفق نظریه بازی با راهبرد چانه زنی و به ارزیابی منافع و هزینه های نظام ثبت اولیه وفق معیار پازنر میپردازد. این پژوهش، نظری- کاربردی بوده و روش تحقیق در آن، کتابخانه ای و روش بررسی مسله و تجزیه و تحلیل داده ها نیز، توصیفی- تحلیلی میباشد. نهایتا، سیستم ثبت اولیه املاک با رویکرد«پویا» و به روش سیستماتیک و «اجرای اثر کامل ثبت ملک» (یعنی شناسایی انحصاری شخصی که نامش در دفتر املاک ثبت شده بعنوان مالک وفق ماده 22 قانون ثبت)، ضمن ایجاد بازی همکارانه و با حاصل جمع مثبت، به «انحصار طبیعی» مدنظر پازنر و کارآیی اقتصادی می انجامد.Analysis of the Legal Relationship and Behavior of Actors in the Legal System of Initial Land Registration Based on Game Theory and Posner Criteria in Economic Efficiency
In the initial Land Registration System, where the Land is registered for the first time, there is a ground for making strategic decisions in the social contract between the “Government” and the “Owners” in entering the initial registration system and choosing its type, Therefore, analyzing their relationships without considering the economic theories of games and Posner, does not achieve the economic efficiency of the registration system. The question is with which strategy the game theory justifies the necessity of the existence of an initial land registration system and what kind of initial registration system, is it economically efficient. The present study, with interdisciplinary analysis, explains the legal behavior of the actors of the registration system according to the game theory with the bargaining strategy and evaluates the benefits and costs of the initial registration system according to the Posner criteria. According to the result, the initial registration system with a “Dynamic Approach” and also “Implementation of the full effect of Land Registration”, while creating a cooperative game with a positive result, “Natural Monopoly” leads to Posner and economic efficiency.
