ضرورت برابری در خون خواهی در فقه سیاسی با تأکید بر مبانی امام خمینی

چکیده
حق خون خواهی بین مسلمانان و غیرمسلمانان از موضوعات چالش برانگیز امروز است. مشهور فقهای امامیه و بعضی فقهای اهل سنّت قائل به کشته شدن غیرمسلمان در برابر قتل مسلمان اند، درحالی که کشتن مسلمان را در برابر قتل غیرمسلمان روا نمی دانند. این حکم با استناد به آیه نفی سبیل، خبر و اجماع استنباط شده است. پس از پیروزی جمهوری اسلامی نیز در قوانین کیفری از این نابرابری تبعیت شده است. علی رغم نظر مشهور فقهای امامیه بر حکم نابرابری، برخی از فقهای معاصر با پشتوانه دیدگاه سیاسی خویش و کرامت انسانی، ادله مشهور را کافی ندانسته و قائل به برابری غیرمسلمان با مسلمان در خون خواهی شده اند. پژوهش حاضر با روش توصیفی تحلیلی، ضمن بررسی و نقد ادله و توجیهات قائلین به نابرابری، حکم را بر مبنای تئوری امام خمینی در نقش زمان و مکان در استنباط سنجیده است و نشان می دهد که در عصر حاضر موضوع سلطه غیرمسلمانان منتفی است. غیرمسلمانان به عنوان شهروند و با رعایت قوانین در کشور اسلامی زندگی می کنند، بنابراین بر اساس فقه سیاسی، برابری در خون خواهی غیرمسلمانان با مسلمانان حکم اسلام است.Necessity of equality in bloodshed in political jurisprudence with emphasis on the principles of Imam Khomeini (PBUH)
The blood feud between Muslims and non-Muslims is one of the most challenging issues today. Famous Imami jurists and some Sunni jurists believe that non-Muslims should be killed in response to the murder of Muslims, while they do not consider it permissible to kill a Muslim in response to the killing of non-Muslims. After the victory of the Islamic Republic, this inequality has been followed. Some contemporary jurists, with the support of their political views and human dignity, have considered the equality of non-Muslims with Muslims in blood. The present article, with a descriptive-analytical method, while criticizing the arguments of those who believe in inequality, has also evaluated the verdict based on Imam Khomeini's theory on the role of time and space in inference, and shows that in the present era, the issue of non-Muslim domination is ruled out. Non-Muslims live in an Islamic country as citizens and abide by the laws, therefore, based on political jurisprudence, the equality of bloodshed between non-Muslims and Muslims is the rule of Islam.
