چکیده
آمریکا ازدهه هفتاد(1990 )و بعد از خروج یک جانبه از توافق هسته ای تحریم های یک جانبه را علیه ایران اعمال کرده که نظام سلامت و حقوق بیماران را از نظر دسترسی به داروهای اساسی با توجه به تحریمهای بانکی و اقتصادی با تهدید جدی روبرو کرده است. با توجه به رأی موقت دیوان بین المللی دادگستری مبنی بر کاهش میزان تحریمها از سوی آمریکا علیه ایران چالشهای حقوقی متعددی را می توان متصور شد. لذا سوال اصلی پژوهش این است که چه چالشهای حقوقی تحریم های یک جانبه آمریکا بر حق سلامت بیماران در پرتو رأی موقت دیوان بین المللی گذاشته است؟ در پاسخ به آن فرضیه پژوهش است که چالشهای حقوقی تحریم های یک جانبه آمریکا را در غالب چالشهای حقوق بشری و چالشهای نقض قوانین بین المللی بررسی می کند.روش مطالعه پژوهش تبیینی- علی با بررسی و مطالعه اسنادمربوط به حوزه سلامت در ایران بدست می آید.The legal challenges of the unilateral sanctions imposed by the United States and their effects on the right to health and education in light of the provisional verdict of the International Court of Justice (ICJ)
The United States has imposed unilateral sanctions on Iran since the 1970s, following the unilateral withdrawal from the nuclear deal, posing a serious threat to the health system and patients' rights in terms of access to essential medicines due to banking and economic sanctions. Is. Given the interim ruling of the International Court of Justice to reduce US sanctions against Iran, several legal challenges can be imagined. Therefore, the main question of the research is what legal challenges the US unilateral sanctions on patients' right to health have posed in the light of the temporary ruling of the International Court of Justice? In response to this is the research hypothesis that examines the legal challenges of unilateral US sanctions in the form of human rights challenges and the challenges of violating international law.
