چکیده
به گواه حقوق بین الملل، اسرائیل از آغازین سال های اعلام موجودیت خویش تا روزگار معاصر همراه یکی از مثال های نقض مقررات و موازین بین المللی است. تجاوز، اشغال، تبعیض، جنایت جنگی، جنایت علیه بشریت و نقض های متعدد دیگر در حوزه حقوق بین الملل بشر نمونه هایی از این دست هستند. اما در این میان ارتکاب ژنوسید در سرزمین های اشغالی توجه چندانی را به دلیل روند آرام، طولانی، مستمر و گاه استفاده از ابزارهای غیرمهلک به خود جلب نکرده است. رویکرد اسرائیل از همان ابتدا یکدست نمودن جمعیت ساکن در سرزمین های اشغالی بوده و به همین دلیل با توسل به ابزارهای مهلک و غیرمهلک در صدد پاک سازی نژادی است؛ پاک سازی باید به هر ترتیب ممکن انجام شود به نحوی که در صورت لزوم با قصد نابودی جزیی یا کلی گروه فلسطینی نیز همراه شود. در این نوشتار ضمن بررسی این شیوه پاک سازی نژادی در قالب ژنوسید به حقایق قابل استناد در این خصوص جهت طرح ایده اقامه دعوا علیه اسرائیل در دیوان بین المللی دادگستری و فروض مختلف مرتبط با آن می پردازیم.Litigation against Israel for Genocide in the International Court of Justice: Possible Scenarios
According to international law, Israel is one of the examples of violations of international rules and principles from the earliest years of its existence to the present day. Aggression, occupation, discrimination, war crimes, crimes against humanity and numerous other violations in the field of international human rights are examples of this. In the meantime, committing genocide in the occupied territories has not attracted much attention due to the slow, long, continuous process and sometimes the use of non-lethal tools. From the very beginning, Israel's approach has been to homogenize the population living in the occupied territories, and for this reason, it seeks ethnic cleansing by using lethal and non-lethal means; the ethnic cleansing must be carried out in any way possible, including, if necessary, with the intention of destroying the Palestinian group in part or in whole. In this article, while examining this method of ethnic cleansing in the form of genocide, we will discuss the facts that can be cited in this regard in order to raise the idea of constituting proceedings against Israel in the International Court of Justice and various related scenarios.
