چکیده
دولت ها برای اجرای مسئولیت های حاکمیتی و اجتماعی خود؛ نیازمند به ایجاد سازمان برای خدمت یا نفع عمومی هستند. سازمان ها در مقام وضع و اجرا دارای یکسری اصول و قواعد هستند. این اصول ماهیتی فرا سازمانی دارند، یعنی هم در درون و هم در بیرون سازمان وجود داشته و می توان از آن ها استفاده نمود. اهم این اصول عبارتند از حاکمیت قانون، سلسله مراتب، تمرکز و عدم تمرکز، مشورت، مدیریت علمی، مسئولیت مدنی. از آنجایی که این اصول در انضباط، انسجام، قانونمندی و مردمی بودن دستگاه های اجرایی نقش مهمی دارند؛ لذا ضروری است مفاهیم آن بر اساس موازین اسلامی متناسب سازی گردد. شیوه پژوهش به روش کتابخانه ای و اسنادی و با بهره گیری از کتب حقوقی و فقهی انجام شده است. اصول سازمان های اداری در حکومت اسلامی منبعث از مبانی دینی است و دارای خصوصیاتی چون بنیادین، ریشه ای، کلی و عام، مستمر و دائمی، ارشادی و عملی است. در حقیقت توجه به اصول سازمان های اداری اسلامی منجر به شکوفایی سازمان و محیط اجتماعی شده و استقرار آن موجب جلوگیری از تضییع حقوق و سوءاستفاده از قدرت و برقراری مفهوم عدالت، نظم و مسئولیت می گردد.Important Principles Governing Administrative Organizations and Their Adaptation with Islamic System of Government with an Emphasis on Imam Khomeini’s Views
Governments are in need of creating organizations for public service or public interests to fulfill their sovereign and social responsibilities. In terms of enactment and enforcement, organizations act upon a set of principles and rules. These principles are trans-organizational in nature, i.e. they are available inside and outside the organization and ready for use. The most outstanding principles, to that end, are the rule of law, hierarchy, concentration and non-concentration, consultancy, scientific management, and civil liability. Since these principles play key roles in establishing order, solidarity, abiding by law, and popularity of the executive organizations, there is a need for proportionality of these concepts with Islamic criteria. The methodology of this work is based on library studies and document research as well as reviewing books on law and jurisprudence. In Islamic system of government, the principles of administrative organizations come from religious essentials, possessing fundamental, constructive, general, constant, sustainable, orthodox and practical elements. Paying attention to principles of Islamic administrative organizations will indeed result in fostering of social organization and environment and its establishment will safeguard the rights of people, prevent abuse of power, and help establishment of the concept of justice, order and responsibility.
