چکیده
نظام مسائل یکی از مباحث جدید در شناخت دانش هاست که زوایای گوناگونی از مسائل طرح شده، طرح نشده و بایسته پژوهش را به روی پژوهشگران می گشاید و می تواند افق های جدیدی را پیش روی جستجوگران دانش ترسیم کند. ازآنجا که فقه سیاسی نرم افزار نظام سیاسی اسلام به شمار می آید، بایسته است به ابعاد گوناگون این گرایش ازجمله نظام مسائل و ساختار آن پرداخته شود که می تواند نقشی مهم در فهم منظومه فقه سیاسی و زمینه پژوهش های نوآمد و غیرتکراری در آن را فراهم کند. نوشته حاضر بر اساس روش توصیفی تحلیلی و استقرایی، به این پرسش اصلی می پردازد که ساختار و نظام مسائل فقه سیاسی چیست؟ و در فرضیه بر این امر تأکید می شود که ساختار و نظام مسائل فقه سیاسی را می توان در دو عرصه کلان ماهیت فقه سیاسی و مسائل آن بررسی کرد. در ماهیت، مباحث چندگانه ای که نگرش درجه دوم به فقه سیاسی دارند، مورد توجه قرار گرفته است؛ مانند هویت معرفتی، مبادی، مبانی، منابع، تاریخ، روش شناسی و مکاتب فقه سیاسی. در مسائل درجه یک فقه سیاسی، ابعاد چهارگانه حاکمیت، حکومت، شهروندان و مرز / سرزمین مورد توجه است که هرکدام به مباحثی مانند مفاهیم و کلیات، اصول و قواعد و مسائل آن حوزه می پردازد. این امر تاکنون کمتر مورد توجه پژوهشگران بوده که دلیل بر نوآوری آن است.An Introduction to the Structure and System of Political Jurisprudence Issues
System of problems is one of the new topics in knowing the knowledge opening different angles of the raised, non-raised and should-be-raised research issues as well as new horizons before researchers. Since political jurisprudence could be considered as the software of the Islamic political system, it is necessary to address the various aspects of this approach, including the system of problems and its structure, which can play an important role in understanding the system of political jurisprudence and pave the way for up-to-date and non-repetitive researches in it. Based on descriptive-analytical and inductive methods, the article addresses this main question: what is the structure and system of political jurisprudence problems? In the hypothesis, it is emphasized that the structure and system of political jurisprudence problems can be examined in two major areas: the essence of political jurisprudence and its problems such as epistemological identity, principles, foundations, sources, history, methodology and schools of political jurisprudence. In first-grade problems of political jurisprudence, the four dimensions of sovereignty, government, citizens and border/territory are considered, each of which dealing with issues such as concepts and generalities, principles and rules and the problems of that field, an innovative issue that has received less attention so far from researchers.
