چکیده
بررسی رابطه ی وضعیت اجتماعی متهمان سرقت و آرای صادره، نشان دهنده ی ارتباط میان دادرسی و ریشه های اجتماعی حقوق است و تعریفی واقعی تر از حقوق حاکم بر جامعه ارائه می دهد. مسائل اصلی که در مقاله حاضر به دنبال پاسخ گویی آن هستیم عبارتند از اینکه: کدام یک از زمینه های خانوادگی و اجتماعی متهمان، مؤثر بر روند دادرسی کیفری از ابتدای ورود به مرجع تعقیب تا اجرای حکم است؟ نحوه ی واکنش نظام دادرسی کیفری به اتهام افراد بر اساس این زمینه ها چگونه است؟ با دسته بندی الگوهای نظری مرتبط با موضوع تحقیق، دو دسته بندی مرسوم در قالب وفاقی (با تأکید بر رویکرد کارکردگرایی) و تضاد مد نظر قرار گرفت. بر این اساس، حساسیت های نظری به منظور پاسخ گویی به مسائل و ورود به میدان تحقیق سامان یافت. برای پاسخ گویی به مسائل تحقیق از روش کیفی و از ابزارهای مصاحبه، تحلیل اسناد و مشاهده در دادسرای ویژه سرقت و ناحیه 12 و دادگاه کیفری دو بعثت تهران استفاده شده است. یافته ها نشان می دهد زمینه های خانوادگی و اجتماعی همچون جنسیت، نسل، پایگاه اقتصادی-اجتماعی، قومیت و تابعیت متهمان بر روند رسیدگی دادرس به سرقت های خشن مؤثر است. یکی از محورهای اصلی استدلال دادرس هنگام صدور رأی ارجاع به این زمینه هاست که به نظر می رسد آفریده ی نظام حقوقی نیستند بلکه یک سری قواعد و کلیشه های برخاسته از ساختار اجتماعی، فرهنگ، دین، اقتصاد و ... هستند.From Diversity of Criminal Judgments in Violent Theft: The Role of Defendant's Social Backgrounds (Field Study of Prosecution Center and Criminal Court of Tehran)
Study of relationship between violent theft defendant’s social backgrounds and judgment can express the social contexts of law and it’s true definition. The main problems, we are going to address is that: which kind of defendant’s familial and social backgrounds influence on criminal procedure from entrance to prosecution service until enforcement stage? How does criminal system react to them through their social status? Classifying relevant theoretical patterns, we concluded to two common functional and conflict perspectives in order to answer the questions and enter our research field. Qualitative method in particular tools like interview, documents analysis and observation in especial-prosecution-center of robbery, prosecution center of 12th district and second-criminal-court of Tehran helped us address our problems. Findings show that familial and social backgrounds like gender, generation, socio-economical statute, ethnicity and nationality influence on criminal procedure of violent theft. Judges consider these factors as one of the main axis of their reasoning while judging that are some rules and cliché rising from social structure, culture, religion, economy and… ..
