چکیده
سبک زندگی اسلامی در مساله ازدواج، فصل بزرگی از کتب فقهی فقهاء را به خود اختصاص داده است. امروزه دغدغه بسیاری از جوانان «همسان همسری» و به تعبیر دینی «کفویت» است که به تبع آن بحث «اجازه و ولایت ابوین در نکاح» که دختران جوان با آن روبرو هستند، مطرح می شود. فقهای امامیه در سه باب: شروط نکاح، آداب و مقدمات نکاح و باب ولایت در نکاح این موضوع را مطرح کرده اند که پژوهش حاضر با رویکرد توصیفی – تحلیلی و با هدف جستجو و مطالعه دیدگاه فقهای امامیه در پاسخ به دو پرسش: ملاک کفائت و احکام نکاح دختر باکره به غیر هم کفو تدوین و روشن گردید که فقهای امامیه در معنا و ملاک کفویت اختلاف نظر دارند. در مساله ملاک کفویت، برخی فقط اسلام، تعدادی اسلام و ایمان(شیعه) و دسته ی سوم ایمان، اسلام و توانایی پرداخت نفقه را شرط کفائت ازدواج می دانند و در بحث نکاح به غیر هم کفو نیز طبق دیدگاه اکثر ایشان حکم نکاح دختر به غیر هم کفو، حق فسخ عقد برای دختر باکره ی رشیده یا ولیّ او می باشد.Kufa' (equal status) criteria and the ruling on marrying a girl to someone of different status according to Imamiyyah jurists.
The Islamic lifestyle concerning marriage is extensively covered in the jurisprudential texts of scholars. Currently, many young people are preoccupied with "homosexuality," or "sufficiency" in religious terms, prompting discussions about "permission and parental guardianship in marriage," particularly for young girls. Imamiyya jurists address this topic in three areas: marriage conditions, marriage etiquette and preparations, and guardianship in marriage. This study adopts a descriptive-analytical approach to explore the views of Imamiyya jurists on two key questions: the criteria for sufficiency and the rulings on a virgin girl's marriage to someone other than a homosexual. It reveals that Imamiyya jurists disagree on the definition and criteria of sufficiency. Some argue that only Islam is sufficient, while others include Shiite faith, and a third group adds the ability to provide maintenance as essential conditions. Regarding marriage to someone outside one's peer group, the majority assert that the right to terminate the contract lies with the adult virgin girl or her guardian.
