چکیده
ارتباط بین حقوق اساسی و حقوق اداری در فرانسه تحت تأثیر نظریه ژرژودل راجع به اساسی سازی حقوق اداری به یکدیگر نزدیک تر شد و نظریه اساسی سازی حقوق اداری پس از آن به روز شد، با تصویب قانون اساسی سال 1958 که در بردارنده مقررات متعددی راجع به حقوق اداری است، بنیان های اساسیِ حقوق اداری تقویت گردید. علاوه بر اینکه تصویب این قانون، نقطه عطفی در اساسی سازی حقوق اداری فرانسه است و از اهمیت بسیار زیادی برخوردار است؛ ارتباط تنگاتنگ بین شورای قانون اساسی و شورای دولتی که در سال های اخیر و با بازنگری های قانون اساسی افزایش یافته است، نقش به سزایی در روند اساسی سازی حقوق اداری و اداری سازی حقوق اساسی ایفا نموده است؛ به گونه ای که این دو جنبش به عنوان چشم اندازی از ایجاد حقوق عمومی اروپایی، موجب غنای متقابل حقوق اداری، حقوق اساسی و وحدت حقوق عمومی در فرانسه شده است.Constitutionalization of Administrative Law in France
The connection between constitutional law and administrative law in France that influenced by Georges Vedell's theory about the »constitutionalization«, cause that this two branch close together. Then, the theory of the constitutionalization of administrative law was subsequently updated. The foundations of administrative law were strengthened by the 1958 constitution, which contained numerous provisions on administrative law. Ratification of this law a landmark in the constitutionalization of French administrative law and have of great importance. The close relationship between the Constitutional Council and the State Council, which has increased in recent years with constitutional revisions, plays an important role in the constitutionalization of administrative law and administratizitaion of constitution law. So, these two movements have seen as the perspective about creation of European public law that cause a reciprocal enrichment of administrative and constitution law and the unity of public law in France.
