چکیده
چالش حقوقی در تضمین حق بر استخدام معلولان در نظام حقوقی ایران در گرو تبیین صحیح نسبت بند (ز) ماده 42 قانون مدیریت خدمات کشوری و ماده 7 قانون جامع حمایت از حقوق معلولان است. برخی دستگاه های اجرایی از جمله وزارت آموزش و پرورش با تفسیری ناروا از قوانین موضوعه، تصمیماتی مغایر حق استخدام مقرر شده در کنوانسیون حقوق افراد دارای معلولیت، مصوب 1387 مجلس شورای اسلامی اتخاذ نموده اند که منجر به صدور آرای وحدت رویه و ابطال بخشنامه توسط هیأت عمومی دیوان عدالت اداری شده است. در پاسخ به این پرسش که ابعاد حق بر استخدام در نظم قوانین و مقررات موضوعه اداری ایران چه می باشد و رویه قضایی هیأت عمومی دیوان عدالت اداری تا چه میزان این حق را تضمین نموده است؟ دیدگاه مقبول این مرجع، تأکید بر لازم الاجراء بودن ماده 7 قانون جامع و ارائه طریقی مبنی بر تکلیف مستقیم دستگاه های اجرایی در اختصاص سهمیه به معلولان است.The right to hire disabled people in Iran's executive agencies emphasizing the case-by-case examination of the General Administrative Court
A proper explanation of the relation between clause G of Article 42 of the State Service Management Act and Article 7 of the Persons with Disabilities Rights and Protection Act is essential for the right of employment of the disabled to be provided by Iranian judicial system. Some organizations, e.g. the Ministry of Education, based on a misinterpretation of the related laws, consolidated decisions contrary to the convention on the rights of persons with disabilities. This has led to the issue of uniformity decisions and revocation of circulars by the General Court. We have investigated the position of the mentioned employment right in the judicial system and the related rules and regulations of Iran, and tried to find the securities the Procedures of the Court have provided for the right. The answer is that the Court has emphasized on the enforcement of Article 7 of the Persons with Disabilities Rights and Protection Act and has directly ruled the administrations to reserve occupations for the employment of persons with disabilities.
