چکیده
بدون تردید امروزه منطقه خاورمیانه شاهد یکسری تضارب آراء می باشد که نوعا رویکردهای ایدئولوژیکی در این منازعات نقش بسیار پررنگی را بازی می نماید البته این تنش علل و متغیرهای زیادی دارد یکی از آنها حضور قدرت های بزرگ در منطقه است حضور نظامی ایالات متحده در راستای تحقق استراتژی و منافع ملی آن کشور در قالب هژمون در برخی مناطق از جمله خاورمیانه باعث بروز درگیری های مستقیم و غیرمستقیم با کشورهای غیرهمسو با آن در منطقه شده است، حال برخی از مواقع، نوع حضور و نزاع طرفین؛ از رودررویی مستقیم به جنگ های نیابتی کشیده می شود که تروریسم داعش و امثالهم به اعتقاد بسیاری از کارشناسان و دلایل غیرقابل انکار در راستای منافع ملی ایالات متحده برای توجیهه حضور در منطقه و کسب منافع در همین راستاست. فلذا برخی از کشورها از جمله ایران نیز برای دفاع از منافع منطقه ای خود در قالب محور مقاومت به کمک های مستشاری مادی و معنوی نسبت به هم پیمانان خود می پردازد؛ نتیجتاً نوعی تقابل نیابتی شکل گرفته درنتیجه فعل وانفعالات آمریکا در منطقه باعث کشته شدن مستشاران ایرانی در کشورهای هم پیمان ایران شده است. در این مقاله درصدد این هستیم با نگاهی توصیفی - تحلیلی با روش اسنادی نحوه احراز مسئولیت حقوقی حامیان حقیقی و حقوقی گروه های تروریستی در قبال کشته شدگان مستشاری ایران (شهدای مدافع حرم اهل بیت (علیه السلام ) در حقوق بین الملل و قوانین داخلی تأکید بر محاکم ایران و ضمانت های اجرایی احکام احتمالی آن موردبحث و بررسی قرار دهیم.Legal responsibilities of sponsors of Takfiri terrorism against martyrs defenders of the Haram and other victims in domestic and international law
