ماهیت حقوقی دعوای قلع و قمع مستحدثاث غیر مجاز در اراضی زراعی و باغات (مقاله علمی وزارت علوم)

چکیده
یکی از پدیده های شوم حال حاضر جامعه، تغییر کاربری غیرمجاز اراضی کشاورزی است که روز به روز می تواند به کاهش امنیت غذایی جامعه منجر شود. با تصویب رأی وحدت رویه شماره 759 مورخ 21/04/1396 هیئت عمومی دیوان عالی کشور، بزه تغییر کاربری غیرمجاز اراضی زراعی و باغ ها درجه 7 محسوب و بنا بر رأی وحدت رویه شماره 822 مورخ 31/03/1401 هیئت عمومی دیوان عالی کشور، بزه مذکور از جرائم آنی تلقی و مرور زمان سه ساله جرائم درجه 7 اعمال و درنهایت با گذشت بیش از سه سال از وقوع بزه مذکور، صدور قرار موقوفی تعقیب به دلیل حدوث مرور زمان صادر می شود. این مقاله در صدد آن است که ضمن اعتقاد راسخ به مجازات نبودن و غیرکیفری بودن قلع و قمع، امکان سنجی کند. حتی با فرض صدور قرار موقوفی تعقیب، ادارات متولی امر می بایست از طریق طرح دعوای شایسته حقوقی ازقبیل قلع و قمع بنا و مستحدثات اراضی زراعی و باغ ها (تغییر کاربری غیرمجاز)، رسیدگی مطابق با تشریفات آیین دادرسی مدنی را از محاکم حقوقی درخواست کنند. ضرورت انجام تحقیق در این است که عدم اعلام به موقع شکایت و شروع تعقیب در برخی پرونده های منتهی به صدور قرار موقوفی تعقیب در مقابل با سایر پرونده هایی که به موقع به تعقیب کیفری و درنهایت صدور حکم قلع و قمع و جزای نقدی از حیث کیفری منجر می شود، سبب احساس تبعیض می شود که می بایست درخصوص چنین اراضی که با مرور زمان مواجه شده اند، چاره ای حقوقی اندیشید. روش تحقیق در مقاله حاضر، با بررسی مبانی حقوقی و قضائی، به سبک تحلیلی توصیفی با شیوه کاربردی است.The Legal Nature of the Decimation Action of Illegal Installations in Agricultural Lands and Gardens

This article aims to assess the feasibility of decimation while firmly believing in the non-punishment and non-criminal nature of vandalism. Even assuming the issuance of a suspension order, the custodian offices should request legal proceedings in accordance with the procedures of the civil procedure through the filing of appropriate legal lawsuits such as the demolition of buildings and the construction of agricultural lands and gardens (unauthorized change of use). . The necessity of conducting an investigation is that the failure to announce the complaint in time and start the prosecution in some cases leads to the issuance of a suspension of prosecution in contrast to other cases that lead to criminal prosecution in time and finally the issuance of a sentence of suppression and a fine from a criminal point of view. It leads to the feeling of discrimination that you should think of a legal solution regarding such lands that have been faced with the passage of time. The research method in this article, by examining the legal and judicial foundations, is in a descriptive analytical style with an applied approach.
