چکیده
زمینه و هدف: حیات و انحلال شخصیت حقوقی بخشی از مقررات تجاری است که براساس موازین قانونی تعیین می شود. در ادامه حیات شخصیت حقوقی، موضوعاتی نظیر موضوعات سیاسی، فرهنگی، اقتصادی تاثیرگذار است، که یکی از این موضوعات، موضوع اقتصادی است. تصمیمات و مصوبه هایی که دولت برای اقتصاد کشور می گیرد، بر عملکرد و حیات شخصیت حقوقی تاثیرگذار است. هدف از انجام این پژوهش تبیین تصمیمات اقتصادی دولت است که بر شخصیت حقوقی تاثیرگذار است. مواد و روش: روش انجام پژوهش توصیفی تحلیلی است. ملاحظات اخلاقی: در انجام پژوهش اصالت متون، صداقت و امانتداری رعایت شده است. یافته ها: موضوعات اقتصادی تاثیرگذار بر شخصیت حقوقی شامل نرخ بهره، ارز، تورم، مقررات ممنوعیت صادرات و واردات، الزام به فروش کالا در بورس و مالیات می باشد. نتیجه: عوامل یاد شده باعث انحلال شخصیت حقوقی می شود، زیرا شرکت توان رقابت خود را از دست می دهد و منحل می شود. شخصیت حقوقی برای بقا و حیات خود نیازمند حمایت از طرف دولت است لذا قانون گذار می تواند شخصیت حقوقی را از موجبات اقتصادی انحلال مصون بدارد و توانایی حیات و عملکرد مناسب را برای شخصیت حقوقی بوجود آورد.The Impact of Economic Issues on the Existence of Legal Entity
Background and Aim: The existence and dissolution of a legal entity are part of commercial regulations determined based on legal standards. For the survival of a legal entity, political, cultural and economic issues are influential and one of these influential issues is economic issue. The decisions and approvals that the government take for country economy affect the performance and existence of the legal entity. The purpose of present study is to explain the economic decisions of government that affect legal entity.
Methods and Materials: Research method is descriptive_analytical.
Ethical Considerations: In present study, the principles of text originality, honesty and trustworthiness have been observed.
Results: The above mentioned factors cause the dissolution of the legal entity because the company loses its competitiveness. The legal entity needs support from government for its survival. Therefore, the legislator can protect the legal entity from economic causes of dissolution and create the ability to exist and function properly for legal entity.
Conclusion: The economic issues affecting the legal entity include interest rate, currency, inflation, regulations and bans on export and import, the obligation to sell goods on stock exchange and taxes.
