چکیده
زمینه و هدف: آزادی اقتصادی همانند آزادی سیاسی و اجتماعی درخور توجه است، زیرا افراد حق دارند که آزادی انتخاب شغل و فعالیت اقتصادی داشته باشند. این آزادی براساس ساختار قانونی شکل می گیرد و کسب درآمد افراد را تضمین می کند. هدف از این پژوهش تبیین آزادی اقتصادی از منظر فقه، قانون و اسناد بین المللی حقوق بشر است. مواد و روش ها: نگارش مقاله به صورت توصیفی تحلیلی بوده است که از منابع کتابخانه ای بهره گرفته است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: بر این امر دلالت دارد که آزادی اقتصادی شهروندان از نظر قوانین داخلی و فقه و اسناد بین المللی حقوق بشری مورد پذیرش قرار گرفته است. نتیجه: از نظر قانون اساسی و قوانین عادی آزادی اقتصادی شهروندان از جایگاه ویژه ایی برخوردار است و دولت ملزم به حذف موانع آزادی اقتصادی شهروندان است. بنا به فقه آزادی اقتصادی شهروندان موافق اصول عامه فقه اسلامی است تا جایی که به دور از غرر باشد. از نظر حقوق بشر نیز آزادی اقتصادی شهروندان، حقوق بشر را تضمین می کند.Economic Freedom of Citizens in Jurisprudence, Iranian law and International Documents of Human Rights.
Background and Aim: Economic freedom is as important as political and social freedom because people have the right to to choose job and economic activity freely. This kind of freedom is formed based on legal structure and it guarantees people's income. The purpose of present study is to explain economic freedom in terms of jurisprudence,law and international human right documents.
Method and Materials: The research method is discriptive_ analytical and library sources have been used.
Results: According to the constitution and normal law, the economic freedom of citizen has a special place and the government is required to remove obstacles of citizen economic freedom. Acccording to the jurisperidance, economic freedom of Citizens agrees with the general principles of the Islamic jurisprudence as far as it is far from jeopardy.Given the human rights considerations, economic freedom of citizens guarantees human rights.
Conclusion: In present study, the principles of text originality,honesty and trustworthiness has been observed.The findings indicate that the economic freedom of Citizens has been accepted in domestic laws , jurisprudence and international documents.
