تحلیل فلسفی رابطه میان قانون مداری و پیشرفت جامعه (مقاله پژوهشی حوزه)

چکیده
یکی از عرصه های مهمی که فلسفه می تواند نقش کابردی مفید و مؤثری داشته باشد، عرصه جامعه شناسی است. با همین هدف، نوشتار پیش رو با تحلیل فلسفی منطقی و با استشهاد به برخی از آیات قرآنی، به این پرسش است می گوید که میان پیشرفت یک جامعه و قانون مداری مردم آن جامعه چه رابطه ای وجود دارد؟ در این راستا، نویسنده نخست سریان قوانین تکوینی عقلی در کل عالم را تحلیل و تبیین می نماید و در پی آن اثبات می کند در جامعه نیز -اعم از اینکه «جامعه» را دارای وجود واقعی یا وجود اعتباری بدانیم- قوانین تکوینی عقلی حاکمیت دارد. طرح مسئله حاکمیت قوانین تکوینی در جامعه، از نظر منطقی به بررسی دیدگاه های مختلف و نقض و ابرام های ارائه شده درباره نوع ترکیب جامعه و اعتباری یا واقعی بودن وجود آن مسبوق است که بخشی از نوشتار پیش رو را به خود اختصاص داده است. مدعای اصلی پژوهش حاضر این است که اولاً یکی از قوانین تکوینی عقلی حاکم بر جامعه این است که «تشکیل و استمرار جامعه بدون قوانین قراردادی محال عقلی است»؛ ثانیاً و بر اساس همین قانون تکوینی عقلی، می توان یکی دیگر از قوانین تکوینی عقلی حاکم بر جامعه را به این مضمون کشف کرد: «پیشرفت یک جامعه بدون قانون مداری مردم آن جامعه، محال عقلی است». نویسنده در این نوشتار با روش تحلیلی-توصیفی و گردآوری محتویات کتابخانه ای، در پی اثبات این دو گزاره است.Ratio-Philosophical Analysis of the Relationship between the Rule of Law and the Progress of Society
One of the important fields in which philosophy can play a useful and effective role is sociology. With this objective and with logico-philosophical analysis and attesting to some Qur'anic verses, the present article is intended to answer the question: "What relationship is there between the progress of a society and the people's observance of the rule of law in that society?" In this regard, first we will analyze and explain the permeation of ratio-creational laws in the entire universe and after that we will prove that in the society – regardless of whether we consider "society" as having a real or a nominal existence – the ratio-creational laws prevail. Proposing the issue of prevalence of the creational laws in the society is logically contingent upon the examination of the different views and the refutations and confirmations presented about the type of composition of the society and its existence as being nominal or real, which is a part of the present article. The main claim of the current research is that: firstly, one of the ratio-creational laws governing the society is: "The formation and continuation of the society without contractual laws is rationally impossible". Secondly, and based on this very ratio-creational law, one can discover another ratio-creational law that governs the society. This law is: "The progress of a society without observing the rule of law by the people of that society is rationally impossible." This article is intended to prove these two propositions with a descriptive-analytical method and the collection of library contents.
