.انکار پس از اقرار در حدود با تأکید بر نقش آن در سرقت و جلد در فقه و حقوق موضوعه

چکیده
یکی از ادله اثبات دعوا، اقرار است که در ضمن آن بحث انکار بعد از اقرار مطرح می گردد. فقها با توجه به ادله نقش یکسانی برای انکار در تمامی حدود قائل نگشته اند، بلکه در برخی موارد همچون حد رجم بالاتفاق، انکار را منشا اثر در اسقاط حد دانسته اند، اما در اسقاط حد قتل، سرقت و حد جلد نقش انکار مورد اختلاف فقها واقع گشته است. در این مقال سعی بر آن است که با بررسی علل تاثیر انکار و عدم آن به قواعدی در این زمینه نائل گشت، تا در موارد مشکوک مورد استناد قرار گیرد. در ذیل بررسی نقش انکار در امور کیفری، ماده 173 قانون مجازات اسلامی جدید نیز مورد بررسی قرار می گیرد تا با بررسی نقاط قوت و ضعف آن پیشنهاداتی در این زمینه ارائه گردد. از جمله نقاط قوت قانون مجازات جدید الحاق قتل به رجم در اثر بخشی به انکار است و از جمله نقاط ضعف آن عدم تفکیک میان حد سرقت با حدود دیگر است که بایستی حکمی متایز از حدود جلدی و در برخی موارد همچون تاثیر انکار در اسقاط حد ملحق به حد رجم و قتل گردد..Denial after Confession" in Punishment, with Emphasis on Its Role in Theft and Lashes Punishment in Jurisprudence and Statute Laws
Confession is one of the evidence for substantiate the claim. It's the topic thatinclude "denial after confession". According to the evidence, the jurists havenot considered a same role for "denial after confession" in all punishments;in some cases, such as the "punishment of stoning to death", they all say thedenial can waive the punishment and in other cases there is disagreementabout that waiving, such as in the punishment of murder, theft, and lashes. Inthis article, by examining the evidences of accepting or ignoring that denial,we search for some rules that can be cited in uncertain cases. Among that, wealso examine the weaknesses and strengths of the Article 173 of the new Islamic Penal Code in order to make suggestions about it. One of the strengthspoints of this law is that it put the punishment for murder near the punishment of stoning to death, in accepting the denial; one of its weaknesses isnot to separat the punishment for theft and other punishments, while thepunishment for theft should be out of lashes punishments in accepting thedenial and should join the punishment for murder and the punishment ofstoning to death.
