چکیده
حفاظت از حقوق مالکیت فکری همواره دغدغه پدیدآورندگان بوده است. با وجود قوانین داخلی و کنوانسیون های بین المللی، ابعادی از حقوق مالکیت فکری همچنان در هاله ای از ابهام قرار دارند. در ایران، در سال های اخیر، حمایت از حقوق مالکیت فکری مورد تأکید قرار گرفته و از آنجا که سالیانه دعاوی متعددی در این حوزه مطرح می شود به نظر می رسد یکی از عواملْ نبودِ سامانه جامع اطلاعاتی است که منجر به تشتت آرا و صدور برخی آرای ناموجه شده است. همچنین رویه ها حاکی از ناکارآمدی برخی دستگاه های ذی ربط در پیگیری قراردادهای مالکیت فکری است. در نوشتار حاضر به این موضوع پرداخته می شود که آیا می توان بلاک چین را برای حفاظت از حقوق مالکیت فکری به کار گرفت و این امر چگونه میسر خواهد شد. استفاده از بلاک چین در زمینه حقوق مالکیت فکری باعث می شود از سیستم تحقیقی استفاده و نوعی نظام جامع اطلاعاتی ایجاد شود که در آن زنجیره مالکیت به صورت تغییرناپذیر قابل مشاهده باشد. در نوشتار پیش رو ابعاد این موضوع بر اساس روش کیفی و با استفاده از ابزار کتابخانه ای بررسی می شود و نخست مفاهیم و مبانی و سپس شیوه های به کارگیری بلاک چین در حفاظت از حقوق مالکیت فکری تبیین می شود.Application of Blockchain in Protecting Intellectual Property Rights and its Practical Dimensions
Protecting intellectual property rights has always been of concern to creators and inventors. Despite domestic laws and certain international conventions, some aspects of intellectual property rights still remain uncertain. In Iran, the issue of intellectual property rights protection has been highlighted in the recent years. As there are several intellectual property rights claims per year it seems that one of the main reasons behind it is probably due to the lack of a management information system. In fact, a lack of such a system has led to different contradictory precedents as well as unjustified pronouncements. Furthermore, the jurisprudence reveals the inefficiency of the relevant organizations in tracking intellectual property rights. The present study analyses whether blockchain can be applied to protect intellectual property rights and how it can be implemented. It seems that blockchain has great potential in this ground. Therefore, having regarded the importance of protecting intellectual property rights in addition to the great potential of blockchain, the present paper discusses the dimensions of the issue through a qualitative research approach with library research tools. In the first section concepts and foundations and the second section, the methods of applying blockchain in protecting intellectual property rights will be surveyed.
