رویکرد حقوق ایران در خصوص میانجی گری برخط (مقاله علمی وزارت علوم)

چکیده
میانجی گری به دلیل ایجاد امکان حل وفصل دعوا به صورت مسالمت آمیز و تعیین نتیجه دعوا توسط خود طرفین روشی مناسب جهت حل اختلافات است. میانجی گری برخط در اختلافات مربوط به تجارت الکترونیک این امکان را برای اشخاص و فعالان تجاری فراهم می سازد که به رغم بعد مسافت و عدم امکان ملاقات حضوری دعوای خود را به صورت مسالمت آمیز حل وفصل کنند. در پژوهش حاضر، میانجی گری برخط از منظر «مفهوم و ویژگی ها»، «مزایا»، «معایب»، «فرایند»، «دعاوی قابل ارجاع»، «اجرای نتیجه»، و «راهکارهای موجود جهت پیشرفت» مورد بررسی قرار گرفت تا با روشن شدن جوانب حقوقی مختلف روش حل اختلاف یادشده اشخاص بتوانند در خصوص مناسب بودن استفاده از این روش حل اختلاف تصمیم بگیرند. مقاله حاضر به این نتیجه نائل آمد که با توجه به ظهور تکنولوژی های متعدد استفاده از میانجی گری برخط میسر است. در عین حال فقدان قابلیت اجرایی نتیجه میانجی گری برخط در اکثر موارد و فقدان تضمین برای عدم افشای اطلاعات محرمانه در فرایند حل اختلاف آن جزء مشکلات اساسی روش یادشده است که با وضع قوانین جامع و آموزش میانجیان می توان این مشکلات را برطرف کرد.Iranian Law Approach about Online Mediation
Mediation is an appropriate dispute resolution method because of the possibility of resolving disputes peacefully and determining the outcome of the dispute by the parties. Online mediation in e-commerce disputes, despite of the special circumstances of the parties due to the distance and impossibility of face-to-face meeting, allow individuals and business activists to resolve their disputes peacefully. In the current study, online mediation has been studied In terms of "concept and characteristics", "advantages", "disadvantages", "process", "resolvable disputes", "enforcement of outcome" and "existing strategies for progress", so that by clarifying the different legal aspects of this dispute resolution method, individuals can decide whether it is appropriate to use this dispute resolution method or not. Finally, the present article has reached the conclusion that due to the emergence of various technologies, in most disputes, online mediation can be exploited. At the same time, the lack of enforceability of online mediation results in most cases and the lack of guarantee for non- disclosure of confidential information in the dispute resolution process are the main problems of this method that can be solved by enacting comprehensive rules and training mediators.
