چکیده
زمینه و هدف: ارسال امواج مغناطیسی و تأثیر آن بر سلامت مردم از موضوعات مهم مرتبط با حق بر سلامت شهروندان بوده است. در این مقاله تلاش شده مسئولیت دولت در ارسال امواج الکترومغناطیسی با رویکرد قواعد فقهی بررسی شود. مواد و روش ها: مقاله توصیفی تحلیلی بوده و با استفاده از روش کتابخانه ای به بررسی سؤال مورد اشاره پرداخته است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانت داری رعایت شده است. یافته ها: منع ورود ضرر و زیان به دیگران از منظر فقهی مورد تأکید است. قاعده مشهور لاضرر و لاضرار فی الاسلام و اتلاف از جمله مستندات متقن فقهی منع ضرر به دیگران است. بر این اساس ارسال امواج الکترومغناطیسی از منظر فقهی و حقوقی فقهی مسئولیت دارد و دولت در این خصوص ضامن است. نتیجه گیری: علی رغم مستندات فقهی و حقوقی در مسئولیت دولت در ارسال امواج الکترومغناطیسی، اثبات ضرر، احراز رابطه سببیت به خصوص در شرایط تعدد و اجتماع اسباب سبب شده است بحث مسئولیت دولت در این خصوص با دشواری مواجه بوده و جبران خسارت از سوی دولت دشوار و شاید غیرممکن به نظر برسدGovernment responsibility in sending electromagnetic waves with the jurisprudential rules approach
Background and Aim: The transmission of magnetic waves and its effect on public health one of the most important issues related to the right to health of citizens has been. In this article, the responsibility of the government in sending electromagnetic waves with the approach of jurisprudential rules is examined. Materials and Methods: Thise article is Analytical descriptive and uses the library method. Ethical considerations: In this article, Originality of texts, honesty and trusteeship Has been complied. Findings: Prohibition of harm to others is emphasized from a jurisprudential point of view. The well-known harmless rule in Islam and wastage rule are among the sound jurisprudential documents forbidding harm to others. Accordingly, transmitting electromagnetic waves is responsible from a jurisprudential and jurisprudential point of view, and the government is the guarantor in this regard. Conclusion: Despite the jurisprudential and legal documents on the responsibility of the government in sending electromagnetic waves, proving the damage, establishing the causal relationship, especially in the conditions of multiplicity and community of causes has caused the discussion of government responsibility in this regard is difficult and compensation by the government is impossible.
