چکیده
در سال های اخیر، نظام حقوقی ایالات متحده امریکا با چالش های جدی در مدیریت تخلفات ارتکابی توسط اعضای نیروهای مسلح مواجه شده است. افزایش تعداد زندانیان و ناکارآمدی سیستم های اصلاحی، به ویژه در مورد جرائم غیرخشونت آمیز، ضرورت بررسی جایگزین های حبس را ایجاب می کند. این پژوهش به دنبال تحلیل سیاست جنایی حاکم بر مجازت های جایگزین های حبس در جرائم نیروهای مسلح ایالات متحده امریکا و شناسایی نقاط قوت و ضعف این تدابیر است. پژوهش حاضر به صورت تحلیلی انجام شده و شامل بررسی سیاست های موجود در نظام حقوقی نظامی ایالات متحده امریکا و تحلیل چالش ها و فرصت های مرتبط با اجرای جایگزین های حبس است. نتایج نشان می دهد که جایگزین های حبس به عنوان ابزارهایی مؤثر برای کاهش بار زندان و تمرکز بر بازپروری و اصلاح رفتار مجرمانه طراحی شده اند. با این حال، چالش هایی نظیر عدم هماهنگی بین نهادهای مختلف، نگرانی های اجتماعی و فرهنگی و هزینه های بالای اجرای برنامه ها مانع از پذیرش و اجرای مؤثر این جایگزین ها می شود. سیاست جنایی جایگزین های حبس در جرائم نیروهای مسلح ایالات متحده امریکا به طور فزاینده ای به سمت رویکردهای انسانی تر و اصلاحی حرکت می کند. این سیاست ها می توانند به کاهش آثار منفی زندان و بهبود وضعیت اجتماعی مجرمان کمک کنند. بنابراین، ضروری است که سیاستگذاران و مقامات قضایی به دنبال راهکارهای مؤثر و انسانی برای مدیریت جرایم نیروهای مسلح باشند و از این طریق به ایجاد یک نظام عدالت کیفری عادلانه تر و مؤثرتر دست یابند.Criminal Policy Alternatives to Imprisonment in Crimes of the United States Armed Forces
In recent years, the US legal system has faced serious challenges in managing offenses committed by members of the armed forces. The increasing number of prisoners and the inefficiency of correctional systems, especially for non-violent crimes, necessitate the examination of alternatives to imprisonment. This study seeks to analyze the criminal policy governing the sanctions of alternatives to imprisonment for crimes committed by the United States Armed Forces and to identify the strengths and weaknesses of these measures.. However, challenges such as lack of coordination between different institutions, social and cultural concerns, and high program implementation costs prevent the effective adoption and implementation of these alternatives.
