امنیت اقتصادی در پرتو نظرهای شورای نگهبان (مقاله علمی وزارت علوم)

چکیده
تفسیر موسع قانون اساسی در حمایت از حقوق مردم و همچنین ضرورت تصویب قوانین جامع می تواند به عنوان اصلی ترین مسئله ای باشد که در صورت اعمال، در حوزه حقوق اقتصاد عمومی بدون شک نتیجه ای در بر نخواهد داشت مگر بهبود شاخص های امنیت اقتصادی کشور. شورای نگهبان به عنوان مفسر و صیانتگر قانون اساسی و حقوق و آزادی های اقتصادی می تواند اساسی سازی حق امنیت اقتصادی را در صلاحیت های قانونی اقتصاد بخش عمومی تضمین نماید و این عملکرد حاصل نمی شود مگر با تبیین امنیت اقتصادی در تمامی ارکان حاکمیتی. شناخت شاخص های امنیت اقتصادی می تواند به عنوان عنصری راه گشا باعث ارتقاء امنیت اقتصادی گردد. هدف از مقاله حاضر که به صورت یک پژوهش کاربردی و توصیفی- تحلیلی می باشد، دستیابی به این نتیجه است که: تاثیر نظرات شورای نگهبان بر امنیت اقتصادی چیست و با ارائه چه الگویی می توان تفسیر شورای نگهبان از قانون اساسی را در جهت حمایت از شاخص های امنیت اقتصادی کارآمدتر نمود. در این رابطه فرض بر این است که عملکرد شورای نگهبان بر شاخص های امنیت اقتصادی دارای تأثیر مستقیم می باشد. در انتها این نتیجه حاصل گردید که: ایجاد یک شیوه تخصصی- تفسیری بر اساس الگوی عالی اجتهاد پویا و ارزش های عالی اقتصادی قانون اساسی می تواند به عنوان الگویی در نظر گرفته شود که در آن امنیت اقتصادی به عنوان رکن اصلی اقتصادی در جامعه مورد حمایت قرار گیرد و باعث بهبود عملکرد شورای نگهبان در راستای بهبود شاخص های امنیت اقتصادی گردد.Economic security in the light of the views of the Guardian Council
The broad interpretation of the constitution in the protection of people's rights and also the necessity of passing comprehensive laws can be considered as the main issue which, if applied, in the field of public economic law, will undoubtedly have no result except the improvement of the country's economic security indicators. The Guardian Council, as the interpreter and guardian of the Constitution and economic rights and freedoms, can guarantee the fundamentalization of the right to economic security in the legal competences of the public sector economy, and this performance cannot be achieved except by explaining economic security in all governing bodies. Knowing the indicators of economic security can improve economic security as a path-breaking element. The purpose of this article, which is an applied and descriptive-analytical research, is to reach the conclusion that: by presenting what model can be interpreted and monitored by the Guardian Council of made the constitution more efficient in order to support economic security indicators. In this regard, it is important to show that the performance of the Guardian Council has a direct effect on economic security indicators. In the end, the conclusion was reached that: creating an interpretation method based on the model The high dynamic ijtihad and high economic values of the Islamic Republic of Iran's constitution can be considered as a model in which economic security is supported as the main economic pillar in the society and improves the performance of the Guardian Council in order to improve security indicators be economical.
