چکیده
شورای رقابت در راستای مسئولیت توسعه رقابت پذیری، صلاحیت قانونی نظارت بر بازار و حراست از فضای کسب و کار کشور را از طریق نظارت بر عملکرد مراجع صادرکننده مجوز و مقابله با هرگونه اخلال در صدور مجوز به عنوان یکی از مصادیق ناکارآمدی اقتصادی دارا می باشد. به جهت عدم تمایل مراجع صدور مجوز کسب و کار اعم از مراجع دولتی و یا حرفه ای به ایجاد تغییر در شرایط بازار از حیث تعداد فعالان هر حوزه و نیز سیاست جلوگیری از گسترش احتمالی رقبا، این نهاد تنظیم گر با نگرشی جامع بر سیاستگذاری های اقتصادی و توسعه ای دولت و برقراری تعادل و توازن میان آزادی فرد و منافع جامعه، ضمن تأکید بر شفافیت قوانین، نظارت خود را بر صدور مجوزهای کسب و کار اعمال می نماید. در عبور از چالش های پیش رو و در جهت تعدیل نقش انحصاری و مداخله گر دولت در نظام مجوزدهی، این مرجع فراقوه ای از ابزار قاعده گذاری و اتخاذ تصمیمات متعدد امری و دارای ضمانت اجرای تعقیبی بهره می گیرد. در صورت تحقق این اقدامات اصلاحی با لحاظ اقتضائات نظم اقتصادی و اقتدار عمومی و از طریق بسترسازی مناسب برای ورود مؤثر بخش خصوصی، می توان انتظار تحقق تسهیل روند فعالیت های اقتصادی و بهبود و ارتقای عمومی فضای کسب وکار را داشت.Legal challenges of the competition authority in facilitating the issuance of licenses Business in Iran

In overcoming the upcoming challenges and in order to adjust the exclusive and interventionist role of the government in the licensing system, this powerful authority uses the tool of rule-making and making numerous imperative decisions with a guarantee of follow-up implementation. If these reform measures are implemented in terms of the requirements of economic order and public authority, and through the creation of a suitable platform for the effective entry of the private sector, we can expect to facilitate the process of economic activities and improve and improve the general business environment.
