نقش قوه قضاییه در پیوند امنیت قضایی و امنیت اقتصادی

چکیده
امروزه امنیت قضایی و امنیت اقتصادی از اصول بسیار مهمی است که همواره در همه نظام های حقوقی مورد استفاده قرار می گیرد. بر این اساس، قوه قضاییه یکی از نهادهای مهم و اساسی در تأمین این اصول به شمار می آید، به طوری که رسیدگی به دعاوی همراه با اجرای عدالت در کشور موجب می شود شهروندان احساس آرامش و امنیت داشته باشند و به دلیل شفافیت سازی رابطه میان شهروندان و حاکمیت، اعمال آزادی های فردی نیز تضمین شده و حتی نهادهای عمومی نمی توانند موقعیت های حقوقی افراد جامعه را به صورت غیرقانونی تغییر دهند. فرضیه و یافته ها مؤید این است که مطابق بند چهاردهم اصل سوم قانون اساسی جمهوری اسلامی ایران، تأمین امنیت قضایی عادلانه و بند دوازدهم اصل سوم و اصل چهل و سوم قانون فوق الذکر نیز امنیت اقتصادی برای همه افراد جامعه پیش بینی شده است. در این راستا، اگر امنیت قضایی به وجود آید، امنیت سیاسی، امنیت اجتماعی، امنیت اقتصادی، امنیت اخلاقی و امنیت فرهنگی هم به وجود خواهد آمد و امنیت اقتصادی شامل اقتصاد مقاومتی، مبارزه با مفاسد اقتصادی، شفاف سازی اقتصادی، مدیریت اقتصادی، نظام توزیع و قیمت گذاری، مقابله با قاچاق و امنیت شغلی است که همه این موارد بخشی از نقشه راه دستگاه قضایی است.The Role of the Judiciary in Linking Judicial Security and Economic Security
Today, judicial security and economic security are very important principles that are always used in all legal systems. Accordingly, the judiciary is one of the fundamental institutions in ensuring these principles, so that the handling of lawsuits along with the administration of justice in the country makes citizens feel calm and secure, and due to the transparency of the relationship between citizens and the government, the exercise of individual freedoms is also guaranteed, and even public institutions cannot illegally change the legal positions of individuals in society. Based on the descriptive-analytical method, the present study seeks to answer the question of what is the role of the judiciary in linking judicial security and economic security? The hypothesis and findings confirm that according to Article 14 of the Third Article of the Constitution, ensuring fair judicial security and Article 12 of the Third Article and Article 43 of the aforementioned law, economic security is also foreseen for all members of society. In this regard, if judicial security is created, political security, social security, economic security, moral security, and cultural security will also be created. Economic security includes a resistance economy, the fight against economic corruption, economic transparency, economic management, a distribution and pricing system, combating smuggling, and job security, all of which are part of the roadmap of the judicial system.
