چکیده
دادگاه عالی قانون اساسی مصر در سال 1971 به عنوان ناظر قانون اساسی و دادگاهی خارج از ساختار سلسله مراتبی دادگاه های عادی تأسیس شد. این دادگاه در مقام صیانت از قانون اساسی سال 2014، صلاحیت های متعددی را بر عهده دارد. از مهم ترین این صلاحیت ها می توان به نظارت بر اساسی بودن قوانین و مقررات، تفسیر متون قانونی، رسیدگی به اختلاف در صلاحیت ایجابی و سلبی میان مراجع و نهادهای قضایی و رسیدگی به دعاوی مربوط به اجرای احکام قطعی متعارض اشاره کرد. نظارت اساسی دادگاه عالی قانون اساسی بر اعمال یکجانبه اداری شامل تمام آن ها نمی شود و آیین نامه های ناظر بر بخش خصوصی و اعمال یکجانبه اداری فردی از قلمروی نظارت اساسی دادگاه خارج اند. این در حالی است که آیین نامه های اجرایی، آیین نامه های سازمان دهنده خدمات عمومی، آیین نامه های انتظامی و آیین نامه های حالت فوق العاده در دایره نظارت اساسی این دادگاه قرار دارند.Controlling the constitutionality of unilateral administrative acts by the Supreme Constitutional Court of Egypt
The Supreme Constitutional Court of Egypt was established as constitutional supervisor and a court out of hierarchical structure of ordinary courts in 1971. This court is responsible for multiple tasks to protect the constitution 2014. Some of the most important of these powers are: controlling the constitutionality of statutes and regulations, interpretation of legal texts, resolve positive and negative dispute in competence between courts and judicial organizations, and resolve claims about execution of contradictory final verdicts. Controlling the constitutionality of unilateral administrative acts by the Supreme Constitutional Court doesn't include all of them. Regulations governing the private sector and personal unilateral administrative acts are out of control by the court; while executive regulations, public service arrangement regulations, discipline regulations and emergency regulations are under the control of constitutionality by this court.
