تحلیل تطورات اذن خروج زن در ادوار مختلف فقه شیعی (مقاله علمی وزارت علوم)

چکیده
در دوره معاصر، مسائل مربوط به حقوق و احکام زن و خانواده اهمیت بیشتری یافته و فقهای متأخر به تفصیل بیشتری به آن پرداخته اند. در زمینه حقوق اجتماعی و خانوادگی در آراء فقها، تفاوت هایی میان زن و مرد وجود داشته که گاه در ادوار مختلف،این فتاوا دستخوش تحولاتی گشته است. یکی از مسائل مهم که با حقوق اجتماعی-سیاسی زن ارتباط تنگاتنگی دارد «لزوم اذن خروج زن» است. پژوهش حاضر با روش تحلیلی توصیفی، «تحولات فتاوای فقهای امامیه راجع به اذن خروج زن » را مورد تحلیل قرار داده است. بررسی ها نشان می دهد که فتاوای اکثر علما در مسأله اذن خروج تا قبل از مواجهه با مدرنیته غالبا بسیار مختصر و با ادبیات یکسان بیان شده، و در مقابل پس از مواجهه مدرنیته و خصوصا هم زمان با پیروزی انقلاب اسلامی ایران با کثرت استفتائات در این مسأله مواجهیم. ارتباط مسأله اذن خروج با زمینه های اجتماعی سیاسی جوامع مسلمین، ارتباط آن با سبک زندگی زنان، لزوم توجه به موضوع شناسی در مسأله اذن خروج و ضرورت تبیین فقهی این مسأله متناسب با الگوی حضور اجتماعی زنان از مهمترین یافته های پژوهش حاضر هستند.Analysis of the development of permission for women to leave in different periods of Shia jurisprudence

One of the important issues related to women's rights is “The need for a woman to leave” The present study has analyzed the developments of the fatwas of the Imami jurists regarding the permission of women to leave with a descriptive-analytical method. Studies show that the fatwas of most scholars on this issue before modernity are often very brief and expressed in the same literature, and in contrast after the modernity and especially at the same time with the victory of the Islamic Revolution in Iran we face many question in this issue. Relationship between this issue and socio-political contexts of Muslim societies and women's lifestyle, the need to pay attention to thematics and the need for a jurisprudential explanation of this issue in accordance with the pattern of women's social presence are the most important findings of this study.
