چکیده
تحقیق حاضر به بررسی مسئله استطاعت بدنی در حج و فروعات فقهی مرتبط با آن پرداخته است. نتایج این تحقیق که به صورت کتابخانه و نرم افزاری و بر اساس تحلیل ادله صورت گرفته حاکی از این است که اگر استطاعت را موضوعی شرعی بدانیم، در روایات ملاکی جز برخورداری از صحت و سلامتی جسمی و روحی را برای آن نمی توان یافت. بنابراین فرد سالم سالخورده با قطع نظر از ادله نفی عسر و حرج مستطیع و مریض نیازمند مراقبت و درمان غیر مستطیع است. اما اگر استطاعت را موضوعی عرفی به حساب آوریم، باید قاصد حج، خواه سالخورده باشد یا مریض، بتواند اعمال و مناسک را خودش یا با کمک و همراهی دیگری انجام دهد تا مستطیع محسوب شود. ملاک تشخیص توان برای حج خود مکلف است و می تواند با بهره گرفتن از نظر پزشک خبره نیز به تعلق وجوب حج بر عهده اش اطمینان یابد. البته کارگزار حاکم می تواند بر اساس تشخیص پزشک معتمد از اعزام زائرانی که در سالهای قبل نام نویسی نموده و در سال اعزام از رفتن به حج ناتوانند منع نماید، مگر اینکه مکلف بتواند فردی را برای مراقبت، با خود همراه سازد.A Reevaluation of the Verdict on Physical Capability in Performing the Hajj Rituals
AbstractThis study discusses the question of physical capability in the Hajj and the relevant jurisprudential issues. The findings of this software and library-based study, founded on the evidence examination, reveal that, when it comes to physical capacity as a religious concern, narrations only mention the possession of physical and mental health. Therefore, a healthy elderly person, regardless of the evidence minimizing discomfort and difficulties, is found capable, while the patient who needs care and treatment is not. However, if we take capability as a common concern, then the Hajj pilgrim—regardless of age or illness—must be able to carry out the Hajj rites either alone or with the assistance and company of another one in order to be deemed capable. The criteria to determine one’s eligibility for the Hajj is the pilgrim himself/herself. Pilgrims can get certainty of their capability to perform the Hajj by seeking the advice of a qualified medical professional. Of course, based on the diagnosis of a reliable medical professional, the controlling agent has the authority to forbid the sending of the pilgrims who have registered in prior years and are unable to perform the Hajj in the year of sending, provided that they have the means to bring a caregiver with themselves
