چکیده
جهان شاهد ایجاد تحولات گسترده در نقش آفرینیِ زنان است. این شرایط به طراحی و ارائه سیاست های اجرایی در حوزه برابری جنسیتی منجر شده است؛ موضوعی که عملکرد و رویه سازمان ملل متحد را نیز تحت تأثیر خود قرار داده است. ازجمله می توان به صدور قطعنامه 1325 شورای امنیت، درخصوص زنان، صلح و امنیت، اشاره کرد تا جایی که کارشناسان، از شکل گیریِ رویه مستقر در جهت افزایش تعداد زنان شاغل در بخش های اداری و اجراییِ سازمان ملل، صحبت کردند و چنین رویه ای را مؤید اهداف پیش بینی شده در منشور سازمان و منشور بین المللی حقوق بشر می دانند. اما نکته ای که در حال حاضر نمی توان آن را نادیده گرفت، رویکرد دیوان بین المللی دادگستری به عنوان رکن قضائی سازمان ملل متحد است. در حال حاضر، از مجموع 15 قاضی دیوان، تنها، 4 کرسی به قضات زن اختصاص دارد. لذا، موضوع اصلیِ پژوهش حاضر، بررسی عملکرد دیوان درخصوص تبعیت از رویه قالب در سازمان ملل، پیرامون افزایش حضور فعال زنان در بخش های اداری و اجرایی است. این مطالعه به روش تحلیلی توصیفی، با استفاده از منابع کتابخانه ای و اینترنتی انجام شده است. یافته های پژوهش بیانگر آن است که با توجه به جایگاه دیوان به عنوان رکن اصلیِ قضائی سازمان ملل، تبعیت از رویه مستقر سازمان و تعهدات ناشی از آن امری گریزناپذیر است. هر چند که در این رابطه، نمی توان منکر نقش مؤثر رویکرد اتخاذ شده از سوی دولت ها هنگام معرفی نامزدها و رأی گیری شد.International Court of Justice and Challenges Ahead from the Perspective of the Presence of Female Judges, with the Emphasis on the Legal-Administrative Procedure of the United Nations
The world is witnessing massive changes in the role of women. These conditions have led to the design and presente of executive policies in the field of gender equality. An issue that has also affectedthe procedure of the United Nations. For example theissuance of Security Council Resolution 1325 regarding women, peace and security. To the extent that the experts have talked about the formation of the established procedure to increase the number of women in the administrative and executive departments of the United Nations, and they consider such a procedure to support the goals foreseen in the organization's charter and the international charter of human rights. . But the point that cannot be ignored is the approach of the International Court of Justice as the judicial pillar of the United Nations. Currently, out of the total of 15 court judges, only 4 seats are reserved for women judges. Therefore, the main topic of the current research is to examine the performance of the Court regarding the compliance with the United Nations procedure, regarding the increase of the presence of women in the administrative and executive departments. This study has been done by analytical descriptive method, using library and internet resources. The findings of the research show that due to the position of the Court as the main judicial pillar of the United Nations, compliance with the established procedure of the organization and the obligations arising from it is inevitable. However, in this regard, the effective role of the approach adopted by governments when introducing candidates and voting, could not be ignored.
