فردگرایی معکوس در فرهنگ جامعه پساانقلابی: مطالعه موردی مصائب قانون و گریز از آن در دانشگاه ایرانی (مقاله علمی وزارت علوم)

چکیده
هدف اصلی مقاله حاضر بررسی مسئله بیگانگی با قوانین در فرهنگ ایران است. برای این منظور، وضعیت قانون در دانشگاه، به مثابه یکی از مهم ترین نهادهای تربیتی شهروند قانون مدار، مطالعه می شود. برای نیل به این هدف، دو سلسله پژوهش توسط نگارنده پیرامون فرهنگ دانشگاه انجام شده است. در پژوهش اول، تخلف های دانشجویی در سه حوزه سیاسی، اخلاقی، و آموزشی بررسی شده است. در پژوهش دوم، رویارویی اساتید دانشگاه با قوانین نظارتی بر کیفیت علمی آنان مطالعه شد. هر دو پژوهش به شیوه کیفی و داده ها به روش مصاحبه عمیق به دست آمد. بر اساس نتیجه گیری، دانشگاه به مثابه یکی از مهم ترین نهادهای تربیت سوژه های متخصص و شهروندان قانون مدار دچار تولید ایجاد ازخودبیگانگی در دانشجویان و اساتید نسبت به قوانین دانشگاه است. بنابراین، اگر در فرهنگ مدرن غرب- بر اساس فرهنگ مصرف گرایی –قانون حافظ فردگرایی است، در ایران گریز از قانون برای مدیریت موقعیت خود به فردگرایی معکوس منجر شده است.Reverse individualism in the Iranian post-revolutionary society: The case study of sufferings of law and the breaking of it in the Iranian university
The main object of the article is to study the problem of alienation from the law in Iranian culture. We thus study the state of the law in the university as one of the most important institutes for educating the legitimate citizen. Then, we have done two types of research about the culture of the university. First, we have researched students’ transgressions in the fields of politics, morality, and education. Second, we did research the professors’ confrontation with the surveillance laws on their process of scientific quality. Consequently, Iranian universities, as one of the most important institutes to educate professional subjects and legitimate citizens are producing alien subjects to university laws. Therefore, if in modern western culture, based on the consumer culture, the law is to defend individualism, in Iran the transgression against the law is to defend the self and it has ended in a reverse individualism.
