چکیده
اصول شکلی حاکم بر بهره برداری از حوضه دجله وفرات اصول شکلی با ارائه چارچوب هنجاری لازم برای اجرای تعهدات ماهوی، نقشی مهم در تنظیم حقوق آب ایفا می کنند. بعلاوه، اصول شکلی می توانند به جلوگیری از بروز اختلافات کمک کنند. مهم ترین این اصول عبارت اند از اصل همکاری، اصل ارزیابی زیست محیطی و اصل اطلاع رسانی و مشورت با کشورهای آسیب دیده. اصول مزبور علاوه بر آن که در زمره قواعد عرفی تلقی می شوند، در برخی کنوانسیون های بین المللی، اسناد بین المللی و توافق های دوجانبه نیز تصریح شده اند. ارزیابی این تعهدات و رویه دولتهای کناره دجله و فرات نشان می دهد که با وجود عضویت این دولتها در پاره ای از اسناد و نهادهای بین المللی و توافق های دوجانبه، در عمل رویکرد موثر و پایداری در اجرای جامع این اصول وجود ندارد و عدم همکاری در اجرای تعهدات شکلی، در تحقق تعهدات ماهوی این حوضه آبریز –از جمله تعهد به بهره برداری منصفانه و متعارف و عدم آسیب رسانی- تاثیر منفی داشته است.Procedural Principles Ruling the Utilization of Tigris-Euphrates River Basin
Procedural Principles Ruling the Utilization of Tigris-Euphrates River Basin. Procedural principles represent a normative framework and play a notable role in regulating water law. In addition, procedural principles could help in preventing the occurrence of disputes. Cooperation, evaluation of environmental impacts and the principle of information and consultation with related countries are the most important procedural principles. These obligations reflect customary rules of law and also are specified in many bilateral, multilateral and international documents. Considering procedural principles together with the practice of Tigris-Euphrates basin countries illustrates that although the neighbouring countries are members of multiple international and bilateral agreements and organs, but in practice the region lacks an effective and sustainable approach in implementing the procedural obligations, which has been leaded to negative impacts on substantial obligations such as no harm and equitable and reasonable utilization.
