چکیده
به محاکمه کشیده شدن جنایتکاران همواره آرمان جامعه بشری بوده است. در این راستا رعایت اصول مورد توجه در حقوق بین الملل کیفری بسیار اهمیت یافته است. این امر حاکی از ضرورت رعایت اصول یک دادرسی عادلانه می باشد و این اصول با موازین حقوق بشر گره خورده است. محاکمه سران حزب بعث و عاملان ترور رفیق حریری به عنوان مهمترین محاکماتی که در سالهای نخستین قرن بیست و یک انجام می گیرد، نیز نیازمند رعایت اصول مذکور است. روشی که در تدوین اساسنامه های دادگاه عالی عراق و دادگاه ویژه لبنان به کار گرفته شده، حاکی از تأثیر شگرف ادبیات حقوق بین الملل کیفری حتی در میان کشورهای خاورمیانه است که نظام داخلی حقوقی شان بر مبنای قواعد اسلامی پیاده شده است. این در حالی است که رسیدگی به جنایات بین المللی و تروریسم در این نقطه از جهان تا پیش از این بی سابقه بوده است، این امر حاکی از فراگیر شدن حقوق بین الملل کیفری در اقصی نقاط جهان می باشد.The Effects of the International Criminal Law in the Middle - East; from the Saddam's Trial to the Hariri's Accused Prosecution
The trial of famous criminals has been always one important objective for human society. In order to achieve this objective we need to obey the international criminal principles which include principles of a fair <br />Trial and human rights. That is why the trial of saddam Hussein and the accused of Hariri's accused prosecution are important. The Hariri's case is especially different from other international cases; this is because of the fact that the jurisdiction of this tribunal is for terrorisms acts while the jurisdiction of the other is restricted to the international crimes such as war crimes. Particularly the statues of these two tribunals are impressed by the international criminal principles. This means the international criminal law is spreading worldwide even in the Middle East and Islamic World.
