بررسی اکراه و امر قانونی و غیر قانونی مافوق نسبت به مادون در نیروهای مسلح

چکیده
گاهی برای حفظ امنیت اجتماعی و اجرای دقیق وظایف و جلوگیری از عدم تبعیت مامور از آمر ، مقام مافوق متوسل به امر و نهی یا اعمال قدرت یا دستور می شود که این مسئله بیشتر در نیروهای مسلح خصوصا در نیروهای انتظامی نمود پیدا می کندزیرا نیروهای مسلح از بالاترین مقام تا پایین ترین رده مانند حلقه های زنجیر به هم پیوسته هستند که در اصطلاح آن را سلسله مراتب گویند . و این امر بسیار حائز اهمیت می باشد که مقام مافوق صلاحیت صدور چنین دستوری را دارد یا خیر! و دستور قانونی می باشد یا خیر ! اگر دستور به درجه اکراه رسد تکلیف چیست ؟ زیرا عدم رعایت شرایط و مقررات امر آمر قانونی موجبات ورود صدمه و خسارات مالی و جانی را به افراد جامعه فراهم می نماید لذا در این مقاله بر آنیم که ویژگی های امر آمر قانونی به همراه نظریات موجود در این زمینه و رویه نظام حقوقی ایران را مورد واکاوی قرار داده زیرا قوانین کیفری ایران از سال 1304 تا کنون در موضوع امر آمر قانونی پنج نوبت تحول داشته است. و بیان نماییم دستور اگر مشمول مقررات اکراه بود به چه نحو اقدام می شود.Examining the reluctance and legal and illegal issues of superiors in relation to subordinates in the armed forces

And it is very important that the superior authority has the authority to issue such an order or not! And the order is legal or not! If the order reaches the level of reluctance, what is the duty? Because failure to comply with the conditions and regulations of the legal order causes injury and financial and life losses to the people of the society, therefore, in this article, we consider the characteristics of the legal order along with the ideas in this field and the procedure of the Iranian legal system. It has been analyzed because the criminal laws of Iran have evolved five times since 1304. And let's state how the order will be acted upon if it is subject to reluctance provisions.
